This is a notable provision in Decree 117/2020/ND-CP on administrative penalties in the field of healthcare.
From November 15: A fine up to 40 million manufacturing mixed cream in Vietnam (Illustrative photo)
To be specific, Article 70 of Decree 117/2020/ND-CP stipulates a fine from 30,000,000 VND to 40,000,000 VND for any of the following acts:
- Failing to implement a quality management system according to the principles and standards of "Good Manufacturing Practice for Cosmetic Products" (CGMP-ASEAN);
- Producing cosmetic products with a formula inconsistent with the product declaration file;
- Using expired materials or materials that do not meet quality standards in the manufacturing of cosmetics;
- Producing substandard cosmetic products;
- Producing at locations not stated in the manufacturing certificate;
- Producing beyond the scope stated in the manufacturing certificate;
- Producing cosmetics containing prohibited substances or exceeding allowed limits for substances regulated by law.
Additionally, this Decree stipulates a fine from 40,000,000 VND to 50,000,000 VND for any of the following acts:
- Producing cosmetic products without a manufacturing certificate;
- Forging documents in the application for issuance, re-issuance, or adjustment of the manufacturing certificate;
- Failing to ensure any of the conditions required after being issued a manufacturing certificate according to the law.
Accordingly, under the above regulations, the act of producing substandard cosmetic products (mixed cream) will be fined from 30,000,000 VND to 40,000,000 VND.
