Recently, the Government of Vietnam has signed and promulgated Decree 32/2020/ND-CP, amending and supplementing a number of articles of Decree 59/2012/ND-CP dated July 23, 2012, on monitoring the implementation of laws.
Currently, the monitoring of the implementation of laws in Vietnam aims to review, assess the actual state of law execution, and propose solutions to enhance the effectiveness of law enforcement and perfect the legal system.
Collaborators are mobilized to monitor the implementation of the law in Vietnam - Internet
In Article 6 of Decree 59/2012/ND-CP, it regulates the participation of organizations and individuals in monitoring the enforcement of the law. However, in Decree 32/2020/ND-CP amending Decree 59, effective from May 15, 2020, collaborators monitoring the enforcement of the law are mobilized to participate in activities such as collecting and synthesizing information, investigating, surveying, and providing opinions on handling the results of monitoring the enforcement of the law.
Based on specific conditions and requirements of monitoring the enforcement of the law, the Ministry, agencies under the Ministry, government agencies, and People's Committees at all levels mobilize the Vietnam Lawyers Association, the Vietnam Bar Federation, and bar associations, the Vietnam Chamber of Commerce and Industry, social and professional associations, research and training organizations, experts, and scientists who meet the conditions to participate in monitoring the enforcement of the law as collaborators. Importantly, these organizations must operate in fields relevant to the area of law enforcement that needs monitoring. Individuals mobilized to participate as collaborators must have a good understanding of the field requiring monitoring of law enforcement.
Furthermore, collaborators monitoring the enforcement of the law shall operate under a contract system for each specific case, except for cases where collaborators are officials or public employees receiving salaries from the state budget.
