The following article will provide information regarding the fact that from March 1, 2025, ministries and departments in Vietnam will operate under new organizational structure.

On February 7, 2025, the Government of Vietnam issued Resolution 27/NQ-CP on the regular Government meeting for January 2025.
The Government of Vietnam urgently requests the completion of the arrangement, streamlining of the government organizational structure, enhancing the effectiveness and efficiency of the state administrative system according to Resolution 18-NQ/TW as follows:
- Ministries, agencies, and localities according to their assigned functions, duties, and authorities:
+ Implement decisively, ensuring the progress of tasks related to the organizational rearrangement based on the Central’s conclusions, National Assembly's Resolutions, directives from the Government, and the Prime Minister, to prevent any disruption or oversight in the operations of ministries, agencies, and local People's Committees, especially those directly affecting citizens, businesses, and related organizations. Closely monitor to promptly address arising obstacles and difficulties during the merger and consolidation process; link the streamlining and restructuring of the organizational apparatus with the restructuring of the staff and innovation of work organization methods.
+ Urgently complete and submit to the Government the draft Decrees on the functions, duties, and authority of ministries, ministerial-level agencies, and government agencies according to the new organizational structure, to be completed before February 15, 2025, ensuring operation from March 1, 2025; review, amend by authority or propose amendments to legal documents related to the organizational apparatus.
- The Ministry of Home Affairs will lead, in coordination with relevant agencies, in completing the draft Law on the Organization of the Government (amended), the Law on the Organization of Local Government (amended), and the National Assembly’s Resolution on the structural organization of the Government for the 15th National Assembly term, the National Assembly’s Resolution on the structure and number of Government members for the 15th National Assembly term, to be submitted to the National Assembly at the 9th extraordinary session. Coordinate closely with ministries and agencies during the drafting, submission, and issuance of the Decrees defining the functions, duties, authority, and organizational structure of ministries, ministerial-level agencies, and government agencies.
- The Ministry of Justice is to complete the draft Resolution of the National Assembly on addressing several issues related to the arrangement and organization of the state apparatus, promptly submitted to the 9th extraordinary session, particularly the 15th National Assembly.
Based on Article 6 of Decree 123/2016/ND-CP, the legal duties of Ministries and Ministerial-Level Agencies are as follows:
- Submit to the Government draft laws, draft resolutions of the National Assembly; draft ordinances, draft resolutions of the Standing Committee of the National Assembly; draft decrees of the Government according to the annual legislative program and plan of the Government, as well as resolutions, projects, and schemes assigned by the Government and the Prime Minister.
- Submit to the Government opinions on draft laws, ordinances prepared by agencies, organizations, and National Assembly delegates for submission to the National Assembly and the Standing Committee of the National Assembly concerning sectors and fields under the management of the Ministry.
- Submit to the Government decisions on measures to implement the Constitution, laws, resolutions of the National Assembly, ordinances, resolutions of the Standing Committee of the National Assembly, orders, and decisions of the President as assigned by the Government and the Prime Minister.
- Submit to the Prime Minister draft decisions, directives, and other documents according to the assignment.
- Issue circulars and other documents on state management concerning sectors and fields under the Ministry's state management; guide and inspect the implementation of these documents.
- Issue joint circulars with the Chief Justice of the Supreme People's Court and the Head of the Supreme People's Procuracy to regulate coordination between the Ministry and the Supreme People's Court, the Supreme People's Procuracy in implementing procedures related to the Ministry's state management scope.
- Direct and organize the implementation of legal propaganda, dissemination, and education in the Ministry’s state management scope.
- Inspect legal documents issued by Ministries, People's Councils, and Provincial and City People's Committees under the Central Government related to sectors and fields under the Ministry's state management scope; if any regulations issued by these bodies are found to contradict legal documents in sectors and fields managed by the Ministry, recommend handling as prescribed by law.
