From July 25, 2019, a Series of New Policies for the Police Force Will Take Effect

Recently, the Government of Vietnam issued Decree 49/2019/ND-CP guiding the implementation of the Law on People’s Public Security 2018. From July 25, 2019, several new regulations on policies concerning officers and non-commissioned officers serving in the People's Public Security will officially come into effect.

1. Supplementing the cases where police officers are discharged to localities

According to the content at Point b, Clause 1, Article 5 of Decree 49/2019/ND-CP from July 25, 2019, additional cases where officers and non-commissioned officers who cease serving in the People's Public Security are discharged to localities. These include those eligible for retirement who request one-time social insurance benefits to emigrate abroad or who are suffering from life-threatening diseases such as cancer, paralysis, cirrhosis with ascites, leprosy, severe tuberculosis, HIV/AIDS, and other illnesses as prescribed by the Ministry of Health.

2. Changes in benefits for officers and non-commissioned officers discharged

According to Clause 2, Article 5 of Decree 49, policies for officers and non-commissioned officers who are discharged have many changes. Specifically:

- Entitled to social insurance benefits and other policies in accordance with the law.- One-time allowance: Each year of service is calculated as one month of the current salary plus an additional allowance for converted increased time.- Job creation allowance equivalent to six times the statutory pay rate at the time of discharge (for those not eligible for retirement or not transfer to other sectors). (Decree 103 does not specify this allowance).

3. Regulations on policies for officers and non-commissioned officers transferring to other sectors

Specifically, according to Clause 1, Article 4 of Decree 49, in case officers and non-commissioned officers transfer to work in establishments funded by the State budget, they shall be ranked and paid salaries according to new job positions from the date of the transfer decision.

Note: If the ranking salary grade is lower than the salary they were receiving at the time of transfer, they will retain their salary and seniority allowances for a minimum of 18 months after the transfer decision, paid by their new workplace.

The decree also stipulates that officers and non-commissioned officers who transfer to work in enterprises or units not funded by the State budget shall receive a one-time allowance for each year of service calculated as one month of the current salary.

For officers and non-commissioned officers who cease serving in the People's Public Security, if they have served in special localities or sectors, their service time will be converted to calculate one-time allowances with the rate: Each year will be entitled to one month’s salary immediately before ceasing service.

4. Changes in policies for officers and non-commissioned officers of the People's Public Security who retire under invalidity policies

According to Article 6 of Decree 49, officers and non-commissioned officers who retire under the invalidity policies are entitled to the following benefits:

- Preferential policies for people with meritorious services to the revolution and social insurance benefits as prescribed by law.- One-time allowance for additional converted service time. Specifically, each year is entitled to one month’s salary of the month immediately before the officers and non-commissioned officers cease serving in the People's Public Security.

In addition, Decree 49 no longer stipulates that this group is entitled to social housing support policies if they do not have accommodations.

5. Police officers who are professors can extend their working time by up to 10 years

This noteworthy content is specified in Article 14 of Decree 49/2019/ND-CP.

Police officers who are professors, associate professors, doctors, and senior experts can extend the period of service to teach and conduct scientific and technological research at higher education institutions and research institutes within the People's Public Security if they meet the following conditions:

- The direct unit utilizing the officers needs more staff against the determined personnel allocation;- They maintain health, qualities, professional expertise, and voluntarily continue working as required.

These individuals can extend their service period one or multiple times, each time not exceeding 2 years (24 months) (the current regulation does not specify this duration). The total extended period is as follows:

- Not more than 10 years for professors;- Not more than 7 years for associate professors;- Not more than 5 years for doctors, senior experts.

During the extended service period, the officers can request to discontinue work to enjoy retirement policies in accordance with the law.

6. Detailed regulations on the salary table of police workers

In addition to the above supplemental regulations, Decree 49/2019/ND-CP also sets out the salary table for police workers, applicable from July 25, 2019. Specifically:
