From August 5, 2020, What Disciplinary Actions are Applied to Militia and Self-Defense Forces?

Recently, the Ministry of National Defense issued Circular 75/2020/TT-BQP stipulating the application of disciplinary measures, procedures, statute of limitations, time limits, and jurisdiction for handling discipline for the militia and self-defense forces, effective August 5, 2020.

According to the provisions in Article 8 of Circular 75/2020/TT-BQP regarding the application of disciplinary forms, procedures, time limits, and authority for handling disciplinary actions concerning militia and self-defense forces, the disciplinary forms for militia are carried out according to the provisions in Clauses 1 and 2 of Article 48 of the Law on Militia and Self-Defense Forces; specifically as follows:

  1. For Militia and Self-Defense soldiers, one of the following disciplinary forms shall be applied:

- Reprimand;- Warning;- Stripping of Militia and Self-Defense title.

  1. For commanding positions of Militia and Self-Defense units, one of the following disciplinary forms shall be applied:

- Reprimand;- Warning;- Demotion;- Dismissal;- Stripping of Militia and Self-Defense title.
