On November 27, 2023, the National Assembly of Vietnam issued the Law on Housing 2023.

From August 1, 2024, what does public housing in Vietnam include?

According to Article 13 of the Law on Housing 2023, public housing includes:

- Official duty housing, including central official duty housing and local official duty housing as per the housing law;

- Resettlement housing invested in or purchased by the State for resettlement but has not yet been allocated, as per the housing law;

- Social housing and housing for the armed forces invested by the State to accommodate those who qualify for social housing policies as per the housing law;

- Housing built with state budget funds or sourced from state budget funds or established as state-owned under legal regulations over various periods, and currently rented out to households or individuals as per the housing law;

- Housing owned by other owners transferred to state ownership under legal regulations not covered in point d of clause 1 of Article 13 of the Law on Housing 2023.

The development, management, and use of public housing are governed by the Law on Housing 2023; where the Law on Housing 2023 does not regulate, the 2017 Law on Management and Use of Public Property will apply.

Ownership representatives of public housing in Vietnam

Article 14 of the Law on Housing 2023 stipulates the ownership representatives of public housing in Vietnam as follows:

- The Ministry of Construction is the representative of the owner of official duty housing, social housing funded by the central budget, and student housing managed by public educational institutions under the Ministry of Construction.

- The Ministry of National Defense and the Ministry of Public Security are the representatives of official duty housing and housing for the armed forces purchased or invested in by these ministries, and student housing managed by public educational institutions under these ministries. For housing under point d of clause 1 of Article 13 of the Law on Housing 2023 managed for lease by the Ministry of National Defense, the Ministry of National Defense is the representative of the owner, except when such housing is transferred to provincial-level People's Committees for management according to legal regulations.

- Ministries, ministry-level agencies, governmental agencies, and other central agencies (collectively referred to as central agencies) are representatives of the owner of official duty housing and student housing managed by public educational institutions under their coordination.

- Provincial-level People's Committees are the representatives of housing invested with local funds as specified in clause 1 of Article 113 of the Law on Housing 2023 and other housing under their management within the province.

Refer to the Law on Housing 2023 which comes into force in Vietnam from August 1, 2024.

The 2014 Housing Law will cease to be effective in Vietnam from the date the Law on Housing 2023 comes into force, except for provisions in point b clause 1, points a, c, d, e, and g clause 2, clause 3, and points a, b, c, d, d, and e clause 5 of Article 198 of the Law on Housing 2023.

State-owned housing defined in legal documents on housing promulgated before the effective date of the Law on Housing 2023 is considered public housing.
