From August 1, 2023, what professional titles are commune-level civil servants entitled to have in Vietnam? (Internet image)
On June 10, 2023, the Government issued Decree 33/2023/ND-CP stipulating commune-level cadres, civil servants, and people working part-time at commune, village, and residential levels.
Specifically, in Clause 2, Article 5 of Decree 33/2023/ND-CP, commune-level civil servants will have the following titles:
- Commander of the Military Command;
- Office - statistics;
- Cadastral - construction - urban and environment (for wards and townships) or cadastral - agriculture - construction and environment (for communes);
- Accouting financial;
- Justice - civil status;
- Sociocultural.
Civil servants are Vietnamese citizens, recruited and appointed to ranks, positions, and titles corresponding to employment positions in agencies of the Communist Party of Vietnam, the State, socio-political organizations at the central, provincial, and district levels; in agencies or units of the People's Army who are not officers, professional soldiers, or defense workers; in agencies and units of the People's Public Security who are not officers, non-commissioned officers serving under the professional regime, or public security workers, on payroll and receiving salaries from the state budget. Latest standards of each title of commune-level civil servant in Vietnam 2023
According to Article 10 of Decree 33/2023/ND-CP, each commune-level civil servant title must meet the following criteria:
(1) Criteria for civil servants and commanders of commune-level Military Commands shall comply with the provisions of specialized military laws.
(2) Standards of civil servants Office - statistics; Cadastral - construction - urban and environment (for wards and townships) or Cadastral - agriculture - construction and environment (for communes); Accouting financial; Justice - civil status; Socio-cultural as follows:
- Age: Full 18 years or older;
- General education level: graduated from high school;
- Professional qualifications: graduated from a university or higher in a training discipline suitable to the requirements and duties of each commune-level civil servant title.
If the law has provisions different from those in this Decree, the provisions of that law shall apply.
(3) Provincial-level People's Committees shall specify standards of professional qualifications from intermediate to higher for commune-level civil servants working in communes, wards, and townships located in mountainous, highland, border areas, islands, island communes, deep-lying and remote areas, ethnic minority areas, and areas with extremely difficult socio-economic conditions.
(4) Based on the criteria of each commune-level civil servant title specified in (2) and the actual conditions of the locality, the People's Committee of the province shall stipulate:
- Specific standards for each commune-level civil servant title to suit the characteristics and requirements of performing tasks at each commune level, but they must not be lower than the standards specified in this Decree;
- The training sector is suitable for the requirements and tasks of each commune-level civil servant title in each recruitment period;
- Formulate plans to create resources, train, and foster each commune-level civil servant title on state management and political theory; foreign languages, informatics, ethnic minority languages (for work areas, ethnic minority languages must be used in official activities), implement regimes and policies, and streamline staffing.
The rights of civil servants shall be exercised according to the provisions of Section 2, Chapter II of the Law on Cadres and Civil servants 2008 (from Article 11 to Article 14), specifically as follows:
- Right of cadres and civil servants to be provided with conditions to assure public-duty performance
+ To be assigned powers corresponding with tasks.
+ To be provided with working equipment and other working conditions according to law.
+ To be supplied with information concerning their assigned tasks and powers.
+ To be trained and retrained in order to raise their political, specialized and professional qualifications.
+ To be protected by law when performing public duties.
- Rights of cadres and civil servants to salaries and salary-related regimes
+ To be paid by the State salaries matching with assigned tasks and powers and suitable to national socio-economic conditions. Cadres and civil servants working in mountainous, border, islands, deep-lying, remote and ethnic minority areas and areas with especially difficult socio-economic conditions or in hazardous and dangerous sectors and occupations are entitled to allowances and incentive policies according to law.
+ To enjoy overtime and night-work pays, working trip allowances and other benefits according to law.
- Rights of cadres and civil servants to rest
Cadres and civil servants are entitled to annual leaves, holidays and leaves to deal with personal affairs according to the labor law. If, due to task requirements, cadres and civil servants do not use or have not used up annual days off, in addition to salaries, they may be paid a sum equal to salaries for days on which they still work.
- Other rights of cadres and civil servants
Cadres and civil servants are assured the rights to learn, do scientific research, participate in economic and social activities; are entitled to incentive policies concerning housing, vehicles, and social and health insurance regimes according to law; if getting injured or dying while performing public duties, they shall be considered for enjoying entitlements and policies applicable to invalids or being recognized as fallen heroes and other rights according to law.
Decree 33/2023/ND-CP takes effect from August 1, 2023.
