This continues to be one of the notable new contents stipulated in the Draft Law amending and supplementing a number of articles of the Law on Officials and Public Employees, which is still in the process of collecting opinions for approval.

To be specific, according to Clause 5, Article 1 of the Draft amending and supplementing Article 37 of the Law on Officials 2008, in addition to the current recruitment forms through examinations or selection, the head of the official management agency may decide to accept the following cases into the official workforce:
- Public employees currently working at public service providers.
- Commune-level cadres and officials.
- Individuals receiving salaries in the people's armed forces; individuals working in the cryptographic sector.
- Individuals currently holding titles or positions in enterprises that are single-member limited liability companies with 100% charter capital owned by the State or appointed as representatives of state-owned capital holding managerial titles in enterprises where the State holds more than 50% of charter capital.
- Individuals who were former officials from district level or higher, subsequently seconded, or transferred by competent authority to work as commune-level officials or transferred to work in public service providers, the people's armed forces, the cryptographic sector, socio-political - professional organizations, social organizations, social-professional organizations or appointed to hold titles, positions in enterprises that are single-member limited liability companies with 100% charter capital owned by the State or appointed as representatives of state-owned capital holding managerial titles in enterprises where the State holds more than 50% of charter capital.
Thus, if this regulation in the Draft is approved, from January 01, 2020, there will be more subjects (including public employees currently working at public service providers) accepted into the official workforce without going through examinations or selection.
