From 2020, a Fine of up to 8 Million VND for Unregistered Vehicles

On December 30, 2019, the Government of Vietnam promulgated Decree 100/2019/ND-CP on administrative penalties in the field of road and railway traffic.

Decree 100/2019/ND-CP has increased the penalties for a series of violations of road traffic regulations, notably increasing the fines for vehicle owners who violate road traffic regulations.

To be specific, according to Point a Clause 4 and Point l Clause 7 Article 30 of Decree 100/2019/ND-CP:

"4. A fine ranging from 400,000 VND to 600,000 VND for individuals, from 800,000 VND to 1,200,000 VND for organizations that are owners of motorbikes, mopeds, and motorbike-like vehicles committing one of the following violations:

a) Failure to carry out the procedure for registering the vehicle under the named owner (to transfer the vehicle registration certificate under one's name) according to regulations when purchasing, receiving as a gift, being allocated, transferred, or inheriting the asset as a motorbike, moped, or motorbike-like vehicle."**

"7. A fine ranging from 2,000,000 VND to 4,000,000 VND for individuals, from 4,000,000 VND to 8,000,000 VND for organizations that are owners of automobiles, tractors, special-purpose vehicles, and car-like vehicles committing one of the following violations:l) Failure to carry out the procedure for registering the vehicle under the named owner (to transfer the vehicle registration certificate under one's name) according to regulations when purchasing, receiving as a gift, being allocated, transferred, or inheriting the asset as an automobile, tractor, special-purpose vehicle, or car-like vehicle;"

Previously, Decree 46/2016/ND-CP only stipulated fines for the above violations at the levels of 1,000,000 – 2,000,000 VND for individuals and 2,000,000 – 4,000,000 VND for organizations owning cars; fines of 100,000 – 200,000 VND and 200,000 – 400,000 VND for individuals or organizations owning motorbikes.

Hence, according to the above regulations, from January 1, 2020, if the owner of motorcycles, cars, and similar types of vehicles fails to carry out the procedure for registering the vehicle under their name following transactions such as buying, gifting, allocation, transfer, or inheritance, they will be fined according to the levels specified in Decree 100/2019/ND-CP.

To be specific, for owners of motorbikes and mopeds, the maximum fine is up to 600,000 VND for individuals and 1,200,000 VND for organizations. Particularly, for car owners, the maximum fine will be up to 4,000,000 VND for individuals and 8,000,000 VND for organizations.
