On November 22, 2006, the Government of Vietnam issued Decree 140/2006/ND-CP regarding the protection of the environment in the stages of planning, appraisal, approval, and organization for the implementation of strategies, plannings, plans, programs, and development projects.

According to Clause 1, Article 6 of Decree 140/2006/ND-CP regulating the phase of formulating strategies, plans, and development plans for environmental protection as follows:
- The strategies, plans, and development plans formulated must ensure the harmony of economic, social development, and environmental protection goals; orient the development objectives and the objectives of environmental protection to comply with sustainable development criteria.
- When formulating strategies, plans, and development plans, the evaluation and forecast of environmental impacts, targets, and measures for environmental protection must be included. In development plans, it is necessary to have indicators for investment to enhance the capacity for environmental management, monitoring, pollution prevention, and treatment, as well as environmental remediation and protection. Environmental indicators must be an integral part of the system of planning indicators at various levels and must be built simultaneously with the socio-economic indicators within the development plans of sectors, fields, and localities.
- The agency assigned to develop strategies, plans, and development plans is responsible for preparing a strategic environmental assessment report simultaneously with the process of formulating the strategy, plan, and development plan.
- The content of the strategic environmental assessment report is carried out in accordance with the provisions of Article 16 of the Law on Environmental Protection.
- When researching and formulating strategies, plans, and development plans, it is necessary to widely collect opinions from ministries, sectors, localities, scientists, and relevant experts. For urban and rural planning, when researching to formulate, it must be publicly announced and opinions solicited from the public and the People's Councils living in the planning area.
