Formulating a Plan for Monitoring the Implementation of the Law before January 30 of the Fiscal Year

On March 5, 2020, the Government of Vietnam signed and issued Decree 32/2020/ND-CP amending and supplementing several articles of Decree 59/2012/ND-CP dated July 23, 2012 on monitoring the situation of law implementation.

In Clause 3, Article 1 of Decree 32/2020/ND-CP supplementing Article 11a of Decree 59/2012/ND-CP, it is stipulated that annually, Ministers, Heads of ministerial-level agencies, Heads of Governmental agencies, and Chairpersons of Provincial People’s Committees are responsible for developing and issuing Plans to monitor the implementation of the law by their ministries, central authorities, and local authorities, and submitting them to the Ministry of Justice before January 30 for monitoring and summarization.

Additionally, the Minister of Justice is responsible for developing and submitting to the Prime Minister of the Government of Vietnam for review and issuance of the Plan to monitor the implementation of the law in key, multi-sector areas before January 1 of the planning year.

Moreover, Decree 32 also regulates the reporting policies on the results of monitoring the implementation of the law, specifically:

- Annually, the Ministry of Justice is responsible for reporting to the Prime Minister of the Government of Vietnam on the monitoring of the implementation of the law nationwide no later than December 25 of the reporting period. The time frame for closing the report data is from December 15 of the year before the reporting period to December 14 of the reporting period.

- Annually, Ministries, ministerial-level agencies, and Governmental agencies are responsible for reporting to the Ministry of Justice on the monitoring of the implementation of the law no later than December 10 of the reporting period. The time frame for closing the report data is from December 1 of the year before the reporting period to November 30 of the reporting period.

- Annually, Provincial People’s Committees report to the Ministry of Justice on the monitoring of the implementation of the law no later than December 10 of the reporting period. The time frame for closing the report data is from December 1 of the year before the reporting period to November 30 of the reporting period.

- District and Communal People’s Committees are to report on the monitoring of the implementation of the law as requested by the directly superior People’s Committees.
