Decree 81/2018/ND-CP was issued by the Government of Vietnam on May 22, 2018, detailing the Commercial Law regarding trade promotion activities. The Decree regulates activities including promotions and trade fairs, and exhibitions.
The decree introduces forms of promotion, including:
- Providing samples of goods or services for customers to try without charge;- Giving away goods or providing services free of charge;- Selling goods or providing services at a price lower than previous prices applied during the announced promotion period;- Selling goods or providing services accompanied by a voucher for purchasing goods or using services;- Selling goods or providing services accompanied by a contest entry form for customers to select winners based on the announced rules and prizes (or other forms of organizing contests and awarding prizes);- Selling goods or providing services with participation in programs of chance, where participation is linked to the purchase of goods or services and winning is based on the luck of the participants according to the announced rules and prizes;- Organizing frequent customer programs, in which rewards are given to customers based on the quantity or value of goods or services purchased, expressed in the form of customer cards, receipts of goods or service purchases, or other forms;- Promoting goods or services through the use of the internet, electronic means, devices, or information technology applications.
Decree 81/2018/ND-CP took effect on July 15, 2018.
