Recently, the Ministry of Justice has issued a document on reporting regime for civil judgment enforcement statistics and regime for monitoring administrative judgments in Vietnam.

On June 10, 2024, the Minister of Justice promulgated Circular 05/2024/TT-BTP stipulating the reporting regime for civil judgment enforcement statistics and regime for monitoring administrative judgments in Vietnam.
Form of report and method of submission of civil judgment enforcement statistical reports in Vietnam as of July 26, 2024 are stipulated in Article 9 of Circular 05/2024/TT-BTP as follows:
Civil judgment enforcement statistical reports are presented in the form of paper documents or electronic documents:
Reports in paper documents must bear the signature and full name of the person preparing the table; the signature, full name of the head of the unit, and the official stamp as required. The statistical reports by the executors must have the signature of the executor and the confirmation of the head of the unit;
Reports in electronic form are presented as images (in pdf format) of the paper report or electronic documents in the form of electronic files authenticated by the digital signature of the head of the civil judgment enforcement agency as per legal provisions.
Civil judgment enforcement statistical reports are sent to the recipient by the following methods:
Sent via official email provided by the Ministry of Justice (*@moj.gov.vn);
Sent on the Document Management Software of the Ministry of Justice (qlvb.moj.gov.vn);
The method for sending civil judgment enforcement statistical reports within the military is carried out according to the regulations of the Ministry of Defense and the instructions of the Execution Department under the Ministry of Defense.
According to Article 8 of Circular 05/2024/TT-BTP, regulations on making civil judgment enforcement statistical reports in Vietnam as of July 26, 2024 are as follows:
At the end of the statistical reporting period, the agencies and individuals stipulated in Clause 1, Article 3 of Circular 05/2024/TT-BTP must finalize figures, close the books to prepare statistical report tables. The results of which period must be reported in that period. It is strictly forbidden to transfer statistical figures arising from the current period to the next period.
At the end of the quarterly, semi-annual, 10-month, and annual statistical reporting periods, the district Civil Judgment Enforcement Agency must finalize figures and create lists of unenforceable cases recorded in separate books; lists of ongoing civil judgment enforcement cases; lists of state compensation cases being monitored and resolved (including cases being handled by the People's Court); lists of civil judgment enforcement cases for credit institutions sent to the provincial Civil Judgment Enforcement Department.
The provincial Civil Judgment Enforcement Department must finalize figures and create lists of unenforceable cases recorded in separate books; lists of ongoing civil judgment enforcement cases; lists of state compensation cases being monitored and resolved (including cases being handled by the People's Court); lists of civil judgment enforcement cases for credit institutions at the provincial Civil Judgment Enforcement Department and consolidate a general list for the entire province to submit to the General Department of Civil Judgment Enforcement for monitoring and management.
The regional Military Judgment Enforcement Office must finalize figures and create lists of unresolved civil judgment enforcement cases, lists of state compensation cases being monitored and resolved, and submit them to the Execution Department of the Ministry of Defense for monitoring and management.
At the end of the annual statistical reporting period, the district Civil Judgment Enforcement Agency must finalize figures and create lists of unresolved civil judgment enforcement cases to carry over to the next period to be submitted to the provincial Civil Judgment Enforcement Department. The provincial Civil Judgment Enforcement Department must finalize figures and create lists of unresolved civil judgment enforcement cases to carry over to the next period and consolidate a general list for the entire province to submit to the General Department of Civil Judgment Enforcement for monitoring and management.
The date for preparing the statistical reports is the date when the executor consolidates the figures and prepares the statistical report to be submitted to the head of the unit or the date when the district Civil Judgment Enforcement Agency, provincial Civil Judgment Enforcement Department consolidates the figures and prepares the statistical report for the entire province to be submitted to the direct superior.
The notation and preparation of statistical reports should follow the instructions in the explanatory form.
