Articles 6 and 7 of Decree 95/2010/ND-CP stipulate that foreign forces licensed to conduct search and rescue in Vietnamese sea must comply with the following principles and conditions:

- Licensing principles

  • Respect for independence, sovereignty and territorial integrity of Vietnam; compliance with the Vietnamese law and treaties to which the Socialist Republic of Vietnam is a contracting party.
  • Timeliness and promptness.
  • Priority and favorable conditions for the immigration process.
  • Specific provision of conditions on and limits of time, space and areas permitted for search and rescue operations in the Vietnamese territory.

- Licensing conditions

Foreign search and rescue forces may be licensed to conduct search and rescue in the Vietnamese territory when fully meeting the following conditions:

  • They are requested by Vietnam or proposed by a country or an international organization to operate in the search and rescue region of Vietnam.
  • They have qualified personnel and equipment relevant to the nature and circumstance of search and rescue.
  • They observe the Vietnamese law and relevant international laws.
  • A licensing agency may refuse or cancel the licensing when foreign search and rescue forces fail to satisfy the conditions specified in Clauses 1, 2 and 3 of this Article or on other matters related to security, defense and health.

More details can be found in Decree 95/2010/ND-CP, which comes into force from November 1, 2010.
