Recently, the Government of Vietnam issued Decree 117/2020/ND-CP on penalties for administrative violations in medical sector in Vietnam.
Fines up to 30 million for forging certificate of eligibility for pharmacy business issued by competent authorities (Illustration)
Article 54 of Decree 117/2020/ND-CP stipulates that a fine ranging from VND 20.000.000 to VND 30.000.000 shall be imposed for commission of one of the following violations in Vietnam:
- Forging or altering any documents or papers issued by competent authorities or relevant organizations/individuals included in the application for issuance of the certificate of eligibility for pharmacy business;
- Using rented or borrowed certificate of eligibility for pharmacy business, or renting, lending or allowing others to use certificate of eligibility for pharmacy business.
Additionally, there is a supplementary form of punishment, which is the revocation of the business eligibility certificate for pharmaceuticals for a period of 24 months for the above violations in Vietnam.
At the same time, offenders must return the illegal gains obtained from renting, borrowing, leasing, lending, or allowing individuals or organizations to use the business eligibility certificate for pharmaceuticals (if any). Authorities are recommended to revoke the business eligibility certificate for pharmaceuticals for the aforementioned violations.
