Fines of up to VND 80,000,000 for producing and processing gas at a facility whose construction has not been approved by a competent authority in Vietnam

This is the notable content in Decree 99/2020/ND-CP of the Government on penalties for administrative violations against regulations on petroleum, and petrol, oil and gas trading in Vietnam, which comes into force from October 11, 2020.

Article 37 of Decree 99/2020/ND-CP stipulates penalties for violations against regulations on conditions to be satisfied by gas-producing and processing entities in Vietnam as follows:

1. A fine ranging from VND 60,000,000 to VND 80,000,000 shall be imposed for any of the following violations:

- Producing and processing gas at a facility whose construction has not been approved and permitted by a competent authority;

- Failure to own a gas quality testing laboratory fully capable of testing the criteria specified in national technical regulations or conclude a contract for hiring it for at least 01 year as prescribed;

- Having lines, machinery and equipment not inspected as prescribed.

2. A fine ranging from VND 80,000,000 to VND 100,000,000 shall be imposed for any of the following violations:

- Producing or processing LNG without having an LNG pumping and filling system for transport or equipment system to serve the gasification to supply to customers;

- Producing and processing CNG without having a CNG compressor station as prescribed.
