Fines of up to 80 Million VND for publishing publication with superstition contents in Vietnam

This is a notable content in Decree 119/2020/ND-CP of the Government of Vietnam on penalties for administrative violations in journalistic and publishing activities, issued on October 07, 2020.

Fines of up to 80 Million VND for publishing publication with superstition contents in Vietnam​ (Illustrative Image)

Article 24 Decree 119/2020/ND-CP stipulates the fines for violations in publication content in Vietnam as follows:

- A fine from VND 10,000,000 to VND 20,000,000 for publishing the publication with less serious false contents for each publication title.

- A fine from VND 20,000,000 to VND 40,000,000 for the act of publishing the publication with contents in one of the following cases:

+ Disclosing the secrets of the organization or individual for each publication title;

+ Serious false contents for each publication title.

- A fine from VND 40,000,000 to VND 80,000,000 for the act of publishing the publication with contents in one of the following cases:

+ Obscenity and debauchery, incitement to violence, superstition or inconformity with Vietnamese fine customs for each publication title;

+ Offending the reputation of the corporate and the honor and dignity of the individual for each publication title;

+ Disclosing state secrets for each publication title but not to the extent where criminal prosecution is needed.

- A fine from VND 80,000,000 to VND 140.000.000 for publishing the publication with serious false contents for each publication title.

- A fine from VND 140.000.000 to VND 200.000.000 for the act of publishing the publication with contents in one of the following cases:

+ Distorting historical truths, denying revolutionary achievements; insulting the nation, personalities and national heroes; prejudicing the national interests; causing national disunity for each publication title;

+ Failure to express or to correctly express national sovereignty over each title of published map.

In addition to monetary fines, certain violations may also result in the application of suspension of activities from 01 to 03 months; mandatory recall of the publication; confiscation and destruction of the publication; mandatory public apology, or forfeiting unlawful gains.

More details can be found in Decree 119/2020/ND-CP, which comes into force in Vietnam from December 1, 2020.
