Fines for violations against regulations on contracts for provision of covered medical services in Vietnam

Recently, the Government of Vietnam issued Decree 117/2020/ND-CP stipulating the administrative penalties in the field of healthcare.

Article 89 of Decree 117/2020/ND-CP stipulates the fines for violations regarding contracts for provision of covered medical services. To be specific:

1. A fine ranging from VND 1,000,000 to VND 3,000,000 for one of the following acts without causing damage to the interests of health insurance participants, medical examination and treatment establishments, and the health insurance fund:

- Unilaterally terminating contracts for provision of covered medical services contrary to the provisions of law;- Signing contracts for provision of covered medical services with contents contrary to the provisions of law;- Signing contracts for provision of covered medical services unauthorized by law.

2. A fine for unilaterally terminating contracts for provision of covered medical services, causing damage to the interests of health insurance participants, medical examination and treatment establishments, or the health insurance fund based on the following levels:

- From VND 3,000,000 to VND 5,000,000 for violations valued under VND 50,000,000;- From VND 5,000,000 to VND 10,000,000 for violations valued from VND 50,000,000 to under VND 100,000,000;- From VND 10,000,000 to VND 15,000,000 for violations valued from VND 100,000,000 to under VND 500,000,000;- From VND 15,000,000 to VND 20,000,000 for violations valued from VND 500,000,000 to under VND 1,000,000,000;- From VND 20,000,000 to VND 30,000,000 for violations valued from VND 1,000,000,000 to under VND 5,000,000,000;- From VND 30,000,000 to VND 40,000,000 for violations valued from VND 5,000,000,000 and above.

3. A fine for signing contracts for provision of covered medical services with contents contrary to the provisions of law or unauthorized, causing damage to the interests of health insurance participants, medical examination and treatment establishments, and the health insurance fund based on the following levels:

- From VND 1,000,000 to VND 5,000,000 for violations valued under VND 50,000,000;- From VND 5,000,000 to VND 10,000,000 for violations valued from VND 50,000,000 to under VND 100,000,000;- From VND 10,000,000 to VND 15,000,000 for violations valued from VND 100,000,000 to under VND 500,000,000;- From VND 15,000,000 to VND 20,000,000 for violations valued from VND 500,000,000 to under VND 1,000,000,000;- From VND 20,000,000 to VND 30,000,000 for violations valued from VND 1,000,000,000 to under VND 5,000,000,000;- From VND 30,000,000 to VND 40,000,000 for violations valued from VND 5,000,000,000 and above.
