On October 4, 2024, the Government of Vietnam issued Decree 123/2024/ND-CP stipulating administrative sanctions in the field of land management.
Article 8 of Decree 123/2024/ND-CP stipulates the fines for repurposing rice cultivation land without permission from competent authorities in Vietnam as follows:
(1) Acts of converting rice cultivation land to other types of agricultural land are subject to the following penalties:
- A fine ranging from VND 2,000,000 to VND 3,000,000 for land area less than 0.5 hectares;
- A fine ranging from VND 3,000,000 to VND 5,000,000 for land area from 0.5 hectares to less than 1 hectare;
- A fine ranging from VND 5,000,000 to VND 10,000,000 for land area from 1 hectare to less than 3 hectares;
- A fine ranging from VND 10,000,000 to VND 30,000,000 for land area of 3 hectares or more.
(2) Acts of converting rice cultivation land to non-agricultural land (excluding residential land) within a commune’s administrative boundary are subject to the following penalties:
- A fine ranging from VND 3,000,000 to VND 5,000,000 for land area less than 0.05 hectares;
- A fine ranging from VND 5,000,000 to VND 10,000,000 for land area from 0.05 hectares to less than 0.1 hectares;
- A fine ranging from VND 10,000,000 to VND 20,000,000 for land area from 0.1 hectares to less than 0.5 hectares;
- A fine ranging from VND 20,000,000 to VND 50,000,000 for land area from 0.5 hectares to less than 1 hectare;
- A fine ranging from VND 50,000,000 to VND 100,000,000 for land area from 1 hectare to less than 2 hectares;
- A fine ranging from VND 100,000,000 to VND 150,000,000 for land area of more than 2 hectares.
(3) Acts of converting rice cultivation land to residential land within a commune’s administrative boundary are subject to the following penalties:
- A fine ranging from VND 20,000,000 to VND 30,000,000 for land area less than 0.01 hectares;
- A fine ranging from VND 30,000,000 to VND 50,000,000 for land area from 0.01 hectares to less than 0.03 hectares;
- A fine ranging from VND 50,000,000 to VND 100,000,000 for land area from 0.03 hectares to less than 0.05 hectares;
- A fine ranging from VND 100,000,000 to VND 150,000,000 for land area from 0.05 hectares to less than 0.1 hectares;
- A fine ranging from VND 150,000,000 to VND 200,000,000 for land area of 0.1 hectares or more.
(4) Acts of converting rice cultivation land to non-agricultural land within the administrative boundary of a ward, commune-level town will be penalized at 2 times the penalty levels specified in provisions (2) and (3) above.
In addition to monetary fines, the following remedial measures shall also be applied:
- Restoring the original condition of the land before the violation, except as prescribed in Clause 3, Article 139 of the Land Law;
- Reimbursing any illicit gains acquired through the illegal act.
Note: The fines specified for the above-mentioned violations apply to individuals. The fines for organizations are twice the fines for individuals committing the same administrative violation. (Clause 2, Article 5 of Decree 123/2024/ND-CP)
