This is a notable new regulation in Decree 15/2020/ND-CP stipulating penalties for administrative violations in the fields of postal services, telecommunications, radio frequencies, information technology, and electronic transactions.

This Decree supplements the act of sending advertising emails and messages to recipients without their consent as a violation of regulations related to emails and messages providing information about products and services.
To be specific, point a Clause 2 Article 94 Decree 15/2020/ND-CP stipulates:
2. Fines ranging from VND 5,000,000 to VND 10,000,000 for one of the following acts:
a) Sending advertising emails and messages to recipients without their consent;
Thus, from April 15, 2020, any act of sending advertising messages and emails without the recipient's consent will be subject to a maximum fine of VND 10,000,000. Currently, Decree 174/2013/ND-CP does not yet stipulate penalties for this act but only regulates the penalties for failing to stop sending emails, messages, or provide content services via messages immediately after receiving a rejection request from the recipient.
According to the definition in Clause 1 Article 3 Decree 90/2008/ND-CP on anti-spam, Spam means emails and messages sent to recipients who do not expect or are not responsible for receiving them as prescribed by law. Spam under this Decree includes spam emails and spam messages.
It can be seen that the situation of people receiving advertising messages and emails without any demand is very common. Therefore, with the newly supplemented sanctions in Decree 15/2020/ND-CP, it is hoped that this situation will be remedied.
