Recently, the Government of Vietnam has issued Decree 117/2020/ND-CP stipulating the penalties for administrative violations in medical sector in Vietnam.
Fine of up to 5 million VND for act of failing to provide adequate lighting in an educational institution as prescribed by law in Vietnam(Illustration)
According to Decree 117/2020/ND-CP, fines for violations against regulations on sanitation and hygiene for prevention of infectious diseases in Vietnam:
1. A warning or a fine ranging from VND 200.000 to VND 500.000 shall be imposed for failing to implement hygiene measures at residences, public areas, vehicles and domestic waste storage areas for preventing infectious diseases.
2. A fine ranging from VND 1.000.000 to VND 3.000.000 shall be imposed for failing to implement hygiene measures at residences, public areas, vehicles and domestic waste storage areas and thus causing or spreading an infectious disease.
3. A fine ranging from VND 3.000.000 to VND 5.000.000 shall be imposed for commission of one of the following violations:
- Failing to provide adequate drink water and clean domestic water that meet quality standards in an educational institution as prescribed by law;
- Failing to build or building sanitation works which do not meet hygiene requirements in an educational institution as prescribed by law;
- Failing to provide adequate lighting in an educational institution as prescribed by law;
- Failing to educate learners in hygiene measures for prevention of infectious diseases, including personal hygiene, hygiene in daily life, labour hygiene and environmental sanitation;
dd) Failing to disseminate information on hygiene and sanitation for disease prevention or failing to inspect and supervise environmental sanitation activities; failing to implement measures for prevention and control of infectious diseases in educational institutions.
4. A fine ranging from VND 10.000.000 to VND 20.000.000 shall be imposed for failing to implement measures for ensuring hygiene in manufacturing/business establishment, treatment of industrial waste and other hygiene measures as prescribed by law, and thus causing or spreading an infectious disease.
Additionally, there will be measures to remediate the consequences by enforcing hygiene measures, disinfection, and sanitization for acts failing to implement hygiene measures at living places, public places, transport means, places for storing household waste, production sites, businesses, industrial waste treatment areas, etc., causing the emergence and spread of infectious diseases.
