This is a notable content in Decree 119/2020/ND-CP of the Government of Vietnam on penalties for administrative violations in journalistic and publishing activities, issued on October 7, 2020.
Fine of 5 million VND for failing to deposit the journalistic products in Vietnam (Illustrative image)
Article 14 of Decree 119/2020/ND-CP stipulates a warning for the act of submitting press depository products at incorrect locations, times, quantities as regulated in Vietnam.
- A fine from 500,000 VND to 1,000,000 VND for acts of not clearly displaying information of printed newspapers, printed journals submitted for depository, circulation quantity, date, time of depository submission, signature of the head of the press agency or the authorized person on the printed newspaper, printed journal submitted for depository.
- A fine from VND 500,000 to VND 1,000,000 for failure to display clear information about the deposited newspaper or print magazine, the quantity of copies, the deposit date and time, the signature of the head of the media organization or authorized person on the deposited print newspaper or magazine in Vietnam.
- A fine from VND 3,000,000 to VND 5,000,000 for the action below:
+ Failure to deposit a journalistic product as required;
+ Failure to archive, in case of the audio or visual newspaper, the program that was transmitted or broadcast in full or within the duration required; failure to archive, in case of the online newspaper or magazine, the full information that was posted or within the duration required;
+ Failure to provide broadcast signals (for audio and visual newspapers), the right to access data (for electronic newspapers, electronic magazines) at the request of the online depositary agency;
+ Failure to ensure the consistency and accuracy between the content of the published or broadcast work and the content of the work provided for the online depository agency.
In addition to being fined, some acts are also subject to specific remedial measures in Vietnam as follows:
- Compulsory implementation of press depository policies for the act of not implementing press depository as regulated;
- Compulsory submission of press depository products at the correct location, quantity for the act of submitting press depository products at incorrect locations, times, quantities as regulated;
- Compulsory provision of accurate published, broadcast content for the act of not ensuring consistency, accuracy between the content of the published, broadcast work and the content of the work provided to the electronic depository implementation agency.
