File on handling prohibited items brought into the prison by Inmates in Vietnam (Illustrative Image)

Article 24 of the military prison regulations issued with Circular 132/2012/TT-BQP stipulates that upon discovering prohibited items brought into the prison, prison officials must prepare a report, require the violator to write a statement, and take the statements of the inmate and witnesses (if any). The report must specifically and accurately describe the quantity, weight, type, shape, size, color, and other characteristics of the prohibited items; and at the same time seal the items that need sealing. Confiscated prohibited items must be securely stored, with a handover record, monitoring log, and must not be lost or damaged. The prison is responsible for arranging a storage warehouse and assigning personnel to manage the prohibited items in Vietnam.

Note: The file on handling prohibited items in Vietnam includes:

- Seizure and sealing report (if the items are sealed);- Statement of the inmate;- Report recording the statements of the violating inmate and witnesses;- Review report of the violating inmate;

- Report of the officer who seized the prohibited items;- Conclusion of the prison disciplinary council or the investigating agency in cases where the violation is not handled criminally;

- Proposal report for the disciplinary action against the violating inmate;

- Disciplinary decision for the violating inmate;

- Report on handling prohibited items (handover report, destruction report, return report to the inmate).

The file on handling prohibited items must be kept in the inmate's dossier.

Details can be viewed at Circular 132/2012/TT-BQP, which comes into force in Vietnam from January 21, 2013.
