The 2019 Population and Housing Census was launched and conducted starting from April 1, extending until April 25, 2019. It is the duty of all Vietnamese citizens to cooperate and provide information to the investigators. So, will there be any sanctions in case of refusal to provide information?
Clause 2, Article 33 of the Statistics Law 2015 stipulates that organizations and individuals subject to statistical investigation are obligated to provide truthful, accurate, complete, and timely information as required by the statistical investigator or the agency conducting the statistical investigation; furthermore, they must not refuse or obstruct the provision of such information.
The cooperation of citizens in census activities is no longer merely encouraged but is a mandated obligation. Additionally, Article 10 of this Law also stipulates that one of the acts strictly prohibited in state statistical activities is “failing to perform or performing incompletely, not promptly, obstructing the provision of information according to the statistical investigation plan, statistical reporting policies, and from administrative data as decided by the competent state agencies.” Therefore, refusing to provide information to the investigator in population statistics will be handled according to the legal provisions.
To be specific, according to the provisions of Article 5 of Decree 95/2016/ND-CP, the act of failing to carry out or obstructing the implementation of statistical investigations, or falsifying statistical investigation information may be fined from 7,000,000 VND to 10,000,000 VND depending on the nature and severity of the violation.
