On December 12, 2013, the Government of Vietnam issued the Decree No. 167/2013/NĐ-CP on sanction of administrative violation in social security, order and safety, prevention and fighting of social evils, fire and domestic violence.
According to Article 9 of the Decree No. 167/2013/NĐ-CP of the Government of Vietnam, sanctions for violation of regulations on management and use of identity card are specified as follows:
- A caution or a fine of between VND 100,000 and 200,000 shall be imposed for one of the acts as follows:
+ Failing to present identity card upon the examination requirement of the competent person;
+ Failing to comply with regulations of law on new issue, re-issue or change of identity card;
+ Failing to comply with regulations of law on recovery, temporary seizure of identity card upon the requirement of the competent persons;
- A fine of between VND 1.000,000 and 2,000,000 shall be imposed for one of the acts as follows:
+ Using the identity card of others to perform acts in contradiction with regulations of law;
+ Erasing or modifying identity card;
+ Renting, borrowing or leasing or lending the identity card to others to perform acts in contradiction with regulations of law;
- A fine of between VND 2,000,000 and 4,000,000 shall be imposed for one of the acts as follows:
+ Committing perjury, forging documents or providing untruthfully information and documents to be issued with identity card;
+ Forging identity cards;
+ Using fake identity card;
- A fine of between VND 4,000,000 and 6,000,000 shall be imposed for mortgage of identity card to perform acts in contradiction with regulations of law
- Additional sanction: Confiscating the exhibits or means used for administrative violation for the acts specified in Clause 2 of this Article;
- Remedial measures: Coercively revoking the identity card for the acts specified at Point b, Clause 2 of this Article.
Thus, in case of being requested by the Traffic Police, if a person fails to present an identity card, he/she will be fined up to VND 200,000.
