Extension of Retirement Age for Officials in Vietnam

The applicable subjects are female officials holding the positions and titles in Vietnam stipulated in Decree No. 53/2015/ND-CP.

The Government of Vietnam has recently issued Decree 53/2015/ND-CP regulating retirement at a higher age for officials as specified in Clause 3, Article 187 of the Labor Code.

The subjects applicable to this Decree are female officials holding the following positions and titles:

- Deputy Head of the Central Party Committees; Deputy Chief of the Central Party Office; Deputy Head of the Central Inspection Committee; Deputy Head of the Northwest, Central Highlands, and Southwest Steering Committees.

- Deputy Head of the Office of the President; Deputy Head of the Office of the National Assembly.

- Full-time Vice Chairpersons of the Ethnic Council of the National Assembly; Full-time Deputy Chairpersons of the National Assembly Committees.

- Deputy Ministers; Deputies of the heads of ministerial-level agencies; heads of agencies under the Government of Vietnam.

- Full-time Vice Chairpersons of the Central Committee of the Vietnamese Fatherland Front; deputies of political-social organizations at the central level.

- Deputy Director of the Ho Chi Minh National Academy of Politics; Deputy Editors-in-Chief of Nhan Dan Newspaper, Deputy Editors-in-Chief of Communist Review; Director of the National Political Publishing House - Truth.

- Military officers in command positions with the rank of general.

- Deputy Party Secretaries of provincial and municipal Party Committees; Chairpersons of the People's Councils, Chairpersons of the People's Committees of provinces and centrally-run cities.

- Vice-Chairpersons of the People's Councils, Vice-Chairpersons of the People's Committees of Hanoi and Ho Chi Minh City.

- Members of the Standing Committees concurrently heading the party committees of Hanoi and Ho Chi Minh City.

Additionally, those appointed to the positions of Judge of the Supreme People's Court and Procurator of the Supreme People's Procuracy are also subject to this Decree.

Conditions for retirement at a higher age in Vietnam

Officials subject to the retirement at a higher age as prescribed in this Decree must meet two conditions: 1- Must be in good health to perform their duties; 2- Must not be under consideration for disciplinary action, investigation, prosecution, trial, or disciplinary execution by the party or government.

For female officials holding the aforementioned positions and titles, the maximum additional working time is 5 years, but not exceeding 60 years of age. These officials, when authorized to retire at a higher age, continue to hold their leadership and management positions.

For those appointed to the positions of Judge of the Supreme People's Court and Procurator of the Supreme People's Procuracy, the maximum additional working time is 5 years, but not beyond 65 years of age for males and 60 years of age for females.

During the period of implementing the higher retirement age policy, if officials wish to stop working, they will be granted a pension as prescribed by law.

The Decree takes effect from July 15, 2015.

The provisions on retirement at a higher age for those appointed to the positions of Judge of the Supreme People's Court take effect from June 1, 2015.
