Export and import activities at industrial and commercial parks in An Giang Border-gate Economic Zone in Vietnam

On December 31, 2007, the Ministry of Finance issued Circular 162/2007/TT-BTC guiding financial policies and customs procedures applicable to the border-gate economic zone in An Giang province in Vietnam.

Circular 162/2007/TT-BTC stipulates export and import activities at industrial and commercial parks and some general regulations on customs for industrial and commercial parks under the An Giang border gate economic zone as follows:

- The exchange relations of goods and services between industrial and commercial parks and the inland of Vietnam are considered as export and import relations and must comply with the regulations of Vietnamese law on the management of export and import of goods and services.

- Organizations and individuals doing business at industrial and commercial parks are allowed to export and import various types of goods, except for those goods included in the List of goods banned from export, banned from import according to Vietnamese law. (Note: The export, import of goods included in the List of goods banned from export, banned from import; the List of goods subject to conditional export, import are carried out according to the current regulations of Vietnamese law.)

- The General Department of Customs establishes industrial and commercial parks customs inspection stations at the entrance and exit gates of industrial and commercial parks. The industrial and commercial parks customs stations are under the direct management of the border gate customs sub-department located in the area with the border gate economic zone.

- Exported, imported, and transited goods; means of transport on exit, entry, and transit shall follow the current customs procedures applicable to that specific type.

- Every 6 months, industrial and commercial parks enterprises are responsible for sending Customs authorities the Settlement Report of materials, raw materials, exported, imported goods in the period, and the Export-Import-Inventory Report. The Customs authorities conduct a cross-check and send it to the Tax authorities for tax determination.

- Within the customs operation area, the Customs authorities shall preside and cooperate with relevant agencies to carry out the task of combating smuggling and illegal transportation of goods across the border according to the provisions of the Customs Law.
