Expenses for International Treaty Activities

On July 01, 2016, the Government of Vietnam issued Decree 74/2016/ND-CP on the management and use of state budget funds to ensure the work of international treaties and international agreements.

The Government of Vietnam lists a series of expenditures for the work of international treaties as follows:

First, expenditures for researching and proposing the negotiation, signing, ratification, approval, accession, amendment, supplementation, extension, termination of validity, renunciation, withdrawal, and temporary suspension of the implementation of international treaties, include:

- Purchasing and collecting documents directly related to the international treaty;- Organizing meetings, conferences, thematic seminars, and collecting expert opinions;- Conducting practical surveys domestically and internationally; assessing the political, defense, security, etc., impact of the international treaty; reviewing and comparing the international treaty with domestic laws and other related international treaties to which Vietnam is a member;- Drafting the international treaty and its amendments and supplements;- Researching and developing negotiation plans; preparing dossiers proposing negotiation, signing, ratification, approval, accession, amendment, supplementation, extension, termination of validity, renunciation, withdrawal, and temporary suspension of the implementation of the international treaty;- ...

Second, expenditures for commenting on proposals for negotiation, signing, ratification, approval, accession, amendment, supplementation, extension, termination of validity, renunciation, withdrawal, and temporary suspension of the implementation of international treaties, include:

- Purchasing and collecting documents directly related to the international treaty;- Reviewing the compatibility of the international treaty with Vietnamese laws and related international treaties;- Researching domestic and international laws and experiences related to the treaty;- Translating related documents;- ...

Third, expenditures for organizing the negotiation and signing of international treaties, include:

- Organizing the reception of foreign negotiation delegations;- Organizing negotiations and signing international treaties domestically or abroad;- Organizing meetings to prepare for negotiations and drafting negotiation minutes;- ...

Fourth, expenditures for inspections by the Ministry of Foreign Affairs and appraisals by the Ministry of Justice regarding proposals to sign or accede to international treaties, include:

- Purchasing and collecting documents directly related to the international treaty;- Reporting independent evaluations on the compatibility of the international treaty with Vietnamese laws and its compatibility with other related international treaties as assigned by competent authorities;- Preparing inspection and appraisal reports;- ...

Fifth, expenditures for the verification by the National Assembly's Foreign Affairs Committee, the Office of the President, the Government Office regarding proposals for negotiation, signing, ratification, approval, accession, amendment, supplementation, extension, termination of validity, renunciation, withdrawal, and temporary suspension of the implementation of international treaties, include:

- Purchasing and collecting documents directly related to the international treaty;- Organizing opinion collection meetings;- Establishing a Verification Council in cases where the international treaty contains important, complex content;- Compiling verification reports.

Sixth, expenditures for deposit, archiving, duplication, and publication of international treaties, include:

- Depositing multilateral international treaties;- Archiving international treaties; documents deciding on negotiation, signing of international treaties; diplomatic notifications, ratification documents, approval of accession to international treaties; authorization documents for negotiating and signing international treaties; authorization letters for attending international conferences and other related documents;- Duplicating international treaties;- ...

Seventh, expenditures for organizing the implementation of international treaties, include:

- Purchasing and collecting documents directly serving the implementation of international treaties;- Developing plans and projects for implementing international treaties;- Propagating and disseminating international treaties;

Eighth, expenditures for inspecting, supervising, and summarizing the signing and implementation of international treaties, include:

- Organizing inspections and supervision activities regarding the signing and implementation of international treaties;- Compiling reports, organizing meetings to evaluate inspection, supervision, and summary reports on the signing and implementation of international treaties.

Ninth, expenditures for providing legal opinions on international treaties, loan agreements, and guarantee agreements of the Government of Vietnam, include:

- Purchasing and collecting directly related documents;- Translating related documents to serve the provision of legal opinions;- Drafting legal opinion documents;- Organizing meetings to collect opinions on related contents to serve the provision of legal opinions.

Tenth, other necessary expenditures directly serving the work of international treaties.
