On October 10, 2024, the Government of Vietnam issued Decree 127/2024/ND-CP amending Decree 05/2011/ND-CP on ethnic affairs.

Expenditures for hospitality and gifts for ethnic minorities in Vietnam from December 1, 2024

To be specific: in Clause 2, Article 12a of Decree 05/2011/ND-CP (supplemented in Decree 127/2024/ND-CP) provisions on expenditure levels for visiting, congratulating, gifting, encouraging, and meeting some units and individuals of ethnic minorities in Vietnam from December 1, 2024 are as follows:

(1) For the following subjects: Former leading officials or high-ranking leaders of the Communist Party and State who are ethnic minorities; Heroes of the Armed Forces, Heroes of Labor, Vietnamese Heroic Mothers, veteran revolutionaries, pre-revolutionary cadres, exemplary revolutionary fighters, retired military officers with general ranks who are ethnic minorities; Former leaders of central departments, ministries, and authorities who are ethnic minorities; Former Secretaries, Deputy Secretaries of the Provincial Party Committees, City Party Committees, Chairmen, Deputy Chairmen of People's Councils and People's Committees of centrally governed provinces and cities who are ethnic minorities:

The maximum expenditure for visiting and gifting will be VND 5,000,000/person/occasion; not exceeding VND 10,000,000/person/year.

(2) Congratulating and gifting on the occasion of Lunar New Year, traditional festivals of ethnic minorities, or when leaders of the Communist Party, State, or the Committee for Ethnic Minority visits and works in localities for the following subjects: People's Teachers, Meritorious Teachers, People's Artisans, Meritorious Artisans, People's Artists, Meritorious Artists, People's Doctors, Meritorious Doctors, professors, associate professors who are ethnic minorities; Branch Secretaries, village leaders, exemplary farmers, religious dignitaries who are ethnic minorities contributing to economic and social development in ethnic minority regions confirmed by the commune-level People's Committee; Ethnic minorities winning international and national awards;

Maximum expenditure: VND 1,000,000/person/occasion; not exceeding VND 3,000,000/person/year;

(3) Visiting, gifting on the occasion of Lunar New Year, traditional festivals of ethnic minorities, or when leaders of the Communist Party, State, or the Committee for Ethnic Minority visits and works in localities for subjects such as poor ethnic minority households residing in ethnic minority areas; visiting, encouraging, and gifting ethnic minorities, ethnic minority households in ethnic minority regions affected by natural disasters, diseases, fires, or other unexpected difficulties;

Maximum expenditure: VND 1,000,000/person, household/occasion; not exceeding VND 3,000,000/person, household/year;

For visiting, encouraging ethnic minorities, ethnic minority households in ethnic minority areas affected by natural disasters, diseases, fires, or other special difficulties with human loss, the expenditure is VND 5,000,000/household/occasion; not exceeding VND 10,000,000/household/year;

(4) Visiting, congratulating, gifting entities such as People's Committees of particularly difficult communes, armed forces units, health stations, nursery education institutions, continuous education institutions, vocational education institutions, higher education institutions, religious institutions in ethnic minority regions; ethnic minority boarding schools, semi-boarding schools, preparatory universities with achievements contributing to ethnic affairs and the building of great national unity, national construction, and defense;

Maximum expenditure: VND 20,000,000/unit, organization/occasion/year;

(5) Organizing meetings with delegations and gifting individuals in the delegation of ethnic minorities formed by authorization of the provincial People's Committee or provincial ethnic affairs agency to visit and work with leaders of the Communist Party, State, Committee for Ethnic Minority.

Maximum gifting expenditure: VND 1,000,000/person/year; other content and expenditure levels will be as per the Ministry of Finance’s regulations on domestic guest reception policies.

In cases where the leaders of the Communist Party or State visit, congratulate, gift, encourage, meet the subjects stipulated in Clause 1 Article 12a of Decree 05/2011/ND-CP (supplemented in Decree 127/2024/ND-CP) as proposed by the Committee for Ethnic Minority Affairs; leaders of the Committee for Ethnic Minority Affaires visit, congratulate, gift, encourage, and meet subjects stipulated in points b, c, d, e, g, h, i, k of Clause 1 Article 12a of Decree 05/2011/ND-CP (supplemented in Decree 127/2024/ND-CP).

More details can be found in Decree 127/2024/ND-CP which comes into force in Vietnam from December 1, 2024.
