Expenditure Standards for Essential Needs Support for Human Trafficking Victims from January 01, 2020

On November 27, 2019, the Minister of Finance issued Circular 84/2019/TT-BTC stipulating the contents and spending levels for victim support activities, the contents, and spending levels specified in Decree 09/2013/ND-CP dated January 11, 2013, of the Government of Vietnam detailing the implementation of certain articles of the Law on Prevention and Combat of Human Trafficking.

Clause 1 Article 4 of Circular 84/2019/TT-BTC stipulates the essential needs support expenditures, including: food allowance, clothing, personal daily necessities, travel costs, etc. Specifically, as follows:

First, food allowance: Providing food allowance during the temporary stay of victims at social protection facilities or victim support facilities: based on the support level for individuals needing urgent protection at social protection facilities as stipulated in Decree 136/2013/ND-CP dated October 21, 2013 by the Government of Vietnam on social assistance policies for social protection beneficiaries. The support period shall not exceed 03 months as specified in Clause 3 Article 25 of Decree 136/2013/ND-CP.

Second, support for clothing and daily personal necessities: During the stay at the facility, victims are provided with daily necessities and other costs as per Clause 4 Article 26 of Decree 136/2013/ND-CP.

- Travel expenses: The support level is based on the fare of public transport. In case the victim is a minor, the reception, rescue, and support agency/unit shall arrange staff to accompany the victim back to their residence by their agency/unit's vehicle, with costs calculated based on actual kilometers and fuel price at the time of transportation; if hiring an external vehicle, the rental price according to the contract agreement must be appropriate to the local market price at the same time.

- Food allowance for travel days: minimum of 70,000 VND/person/day.

Additionally, this Circular stipulates policies for academic study support, vocational training, and initial hardship allowance for victims of human trafficking:

- Victims are exempted, reduced tuition fees, and supported with study costs according to the regulations in Decree 86/2015/ND-CP dated October 2, 2015, by the Government of Vietnam on the mechanism for collection, management of tuition fees for educational institutions under the national education system and policy for tuition fee exemption, reduction, support of study costs from the academic year 2015 - 2016 to the academic year 2020 - 2021, Decree 145/2018/ND-CP dated October 16, 2018, by the Government of Vietnam amending and supplementing some articles of Decree 86/2015/ND-CP and guiding documents of the Decree.- In case victims pursue short-term vocational training of less than 3 months, they shall receive one-time vocational training support. The support level is equivalent to the respective short-term vocational training cost at local vocational training facilities but shall not exceed the limit stipulated in Clause 1 Article 7 of Circular 152/2016/TT-BTC dated October 17, 2016, by the Ministry of Finance on managing and using financial support for primary vocational training and training less than 03 months.- One-time initial hardship allowance for victims in poor households when returning to their residence of at least 1,000,000 VND/person (poor households supported are those with income criteria).
