Ordinance on the Implementation of Democracy in Commune, Ward, Commune-level Town 2007 was promulgated on April 20, 2007. Notably, in this document, there are provisions regarding the binding effect of matters discussed and decided by the people.
To be specific:, pursuant to Article 19 of the Ordinance on the Implementation of Democracy at Commune, Ward, and Commune-Level Town 2007, the enforceability for matters that the people discuss and vote on is specified as follows:
- For matters regarding the village conventions and regulations of villages and residential groups, if more than 50% of the total number of voters or voters representing households in the village or residential group agree, it shall be enforceable after the district-level People's Committee issues a recognition decision.
- For matters regarding the election, dismissal, and recall of Village Heads and Heads of Residential Groups, if more than 50% of the total number of voters or voters representing households in the village or residential group agree, it shall be enforceable after the commune-level People's Committee issues a recognition decision.
- For matters regarding the election and recall of members of the People's Inspection Board and the Community Investment Supervision Board, if more than 50% of the total number of voters or voters representing households agree, it shall be enforceable after being recognized by the commune-level Vietnam Fatherland Front Committee.
Additionally, the Ordinance also stipulates that the recognition of matters discussed and voted on by the people regarding the village conventions and regulations of villages and residential groups shall proceed as follows:
- The Village Head and Head of Residential Group are responsible for immediately reporting the results of the discussions and votes to the commune-level People's Committee;- Within three working days from the date of receiving the report from the Village Head or Head of Residential Group, the commune-level People's Committee must prepare a dossier to submit to the district-level People's Committee;- Within seven working days from the date of receiving the submission dossier from the commune-level People's Committee, the district-level People's Committee must review and issue a recognition decision; in case of non-recognition, a written response stating the reasons must be provided.
Recognition of the results for the election, dismissal, and recall of Village Heads and Heads of Residential Groups:
- The person presiding over the village or residential group meeting is responsible for preparing a minute and immediately reporting the results of the election, dismissal, and recall of Village Heads and Heads of Residential Groups to the commune-level People's Committee;- Within five working days from the date of receiving the report, the commune-level People's Committee must review and issue a recognition decision; in case of non-recognition, a written response stating the reasons must be provided.
Recognition of the results for the election and recall of members of the People's Inspection Board and the Community Investment Supervision Board:
- The person presiding over the meeting is responsible for immediately reporting the results of the election and recall of members of the People's Inspection Board and the Community Investment Supervision Board to the commune-level Vietnam Fatherland Front Committee;- Within five working days from the date of receiving the report, the commune-level Vietnam Fatherland Front Committee must review and recognize the results; in case of non-recognition, a written response stating the reasons must be provided.
