Exceptions to Most-Favored-Nation Treatment in Trade of Goods and Services

Ordinance on Most-Favored-Nation Treatment and National Treatment in International Trade 2002 was promulgated on May 25, 2002. The Ordinance stipulates certain exceptions to the most-favored-nation treatment in goods trade and services trade.

To be specific, according to the provisions in Article 8 and Article 10 of the Ordinance on Most Favored Nation Treatment and National Treatment in International Trade 2002, most-favored-nation treatment in trade in goods does not apply to:

- Preferences for members of economic linkage agreements that Vietnam has concluded or acceded to;- Preferences for countries sharing a border with Vietnam aimed at facilitating the border trade of goods based on bilateral agreements;- Preferences for developing countries and less developed countries;- Preferences under transit goods agreements that Vietnam has concluded or acceded to;- Procurement bidding for goods for projects using funding from international organizations or foreign countries and other projects as stipulated by the Government of Vietnam.

Simultaneously, most-favored-nation treatment in trade in services also does not apply to:

- Exceptions to most-favored-nation treatment for service sectors specified in bilateral or multilateral agreements that Vietnam has concluded or acceded to;- Preferences for services and service providers of countries sharing a border to promote service trade activities between Vietnam and such countries;- Preferences for foreign services and service providers as stipulated in regional economic agreements, free trade area agreements, and other similar agreements that Vietnam has concluded or acceded to;- Procurement bidding for services for projects using funding from international organizations or foreign countries and other projects as stipulated by the Government of Vietnam;- Other cases as decided by the Government of Vietnam.
