1. What is needed for a complete set of documents to establish a salary scale and payroll?

According to labor law regulations, the documents to establish a salary scale and payroll include:

- Salary scale and payroll system;- Official Dispatch requesting registration for the salary scale and payroll system;- Decision promulgating the salary scale and payroll system;- Minutes approving the salary scale and payroll system;- Table of regulations on standards and conditions for applying roles;- Regulation on salary, bonuses, and allowances.

2. Level I salary must not be lower than the regional minimum wage

According to Article 7 of Decree 49/2013/ND-CP on the principles of establishing a salary scale and payroll, the lowest (starting) salary for a job or position in the salary scale and payroll determined by the company based on the complexity of the job or position corresponding to the level of education, skills, responsibility, and experience required to perform the job or position shall:

- The lowest salary for the simplest job or position under normal working conditions must not be lower than the regional minimum wage;- The lowest salary for a job or position requiring trained labor, vocational training (including workers trained by the enterprise itself) must be at least 7% higher than the regional minimum wage;- The salary for jobs or positions with strenuous, hazardous, or dangerous working conditions must be at least 5% higher; jobs or positions with particularly strenuous, hazardous, or dangerous working conditions must be at least 7% higher than the salary for jobs or positions of equivalent complexity performed under normal working conditions.

The differential between two adjacent salary grades must ensure that employees are encouraged to improve their professional, technical, and business skills, accumulate experience, and develop talent, with a minimum increase of 5%.

According to the provisions of Article 3 of Decree 141/2017/ND-CP, the regional minimum wage for 2018 is as follows: Enterprises operating in areas classified under region I are 3,980,000 VND/month; region II is 3,530,000 VND/month; region III is 3,090,000 VND/month; region IV is 2,760,000 VND/month.

3. Enterprises must submit salary scale and payroll documents according to proper procedures

According to the guidelines in Decision 1858/QD-LDTBXH, the procedure for submitting the salary scale and payroll of enterprises includes the following steps:

- Step 1: Enterprises establish a salary scale and payroll according to the principles stipulated by the Government of Vietnam;- Step 2: Enterprises submit the set of documents to establish the salary scale and payroll as stipulated to the District Division of Labor, War Invalids, and Social Affairs where the enterprise is located;- Step 3: The district-level state management agency receives the registered salary scale and payroll.

Method of implementation: Directly or by post.

Documents and quantity required: 02 sets, the enterprise keeps 01 set and sends 01 set to the District Division of Labor, War Invalids, and Social Affairs.
