Environmental Protection in the exploration, extraction, processing, and use of Minerals in Nghe An Province, Vietnam

On December 20, 2008, the People's Council of Nghe An province, Vietnam issued Resolution 245/2008/NQ-HDND approving the Planning for exploration, exploitation, processing, and use of various minerals for the period 2009-2020.

Resolution 245/2008/NQ-HDND provides solutions for environmental protection during the exploration, exploitation, processing, and utilization of various types of minerals in Vietnam for the period 2009-2020 as follows:

- Establish regulations for mandatory environmental deposit for mining and mineral processing facilities in the region. Implement strict penalties to ensure that enterprises contribute to the fund according to regulations without exceptions.

- Allocate partial funding from the Central and Local budgets for the construction of key projects related to wastewater treatment, site reclamation, and the restoration of agricultural and forestry land.

- Strengthen environmental inspection and control activities. Form a specialized unit equipped with adequate facilities and personnel to monitor and manage the environment.

- Create an environmental protection fund supported by 1% of the local budget to cover activities such as inspection, research, application of new technologies, or supporting environmental protection measures.

- Implement Decision No. 64/2003/QD-TTg of the Prime Minister of the Government of Vietnam dated April 22, 2003, approving the Plan to thoroughly handle facilities causing serious environmental pollution, including 26 tin mining sites in Quy Hop, Nghe An Province from 2003-2006 through planning and advancements in organization and production technology to address pollution caused by tin mining.

More details can be found in Resolution 245/2008/NQ-HDND which comes into effect in Vietnam from December 30, 2008.
