Entitled to Preferential Tariffs under EVFTA with These 03 Origin Documents

This is an important content of Circular 11/2020/TT-BCT prescribing the Rules of Origin for goods under the Free Trade Agreement between Vietnam and the European Union (EVFTA Agreement).

Tariff Preference According to EVFTA, 11/2020/TT-BCT

Eligible for tariff preference according to EVFTA if one of the following 03 certificates of origin is presented (illustration)

In Article 19 Circular 11/2020/TT-BCT, it is stipulated that goods originating from the European Union imported into Vietnam shall enjoy tariff preferences according to EVFTA when submitting one of the following certificates of origin:

- C/O issued in accordance with the provisions from Articles 20 to 23 of Circular 11/2020/TT-BCT.

- Self-certification of origin according to the provisions of Article 24 of Circular 11/2020/TT-BCT issued by an eligible exporter under EU regulations for consignments of any value; or any exporter for consignments not exceeding 6,000 EUR (six thousand euros).

- Self-certification of origin issued by an exporter registered in the electronic database in accordance with EU regulations and notified to Vietnam. The notification may include the EU's regulation on suspending the application of points a and b of Clause 1 Article 19 of Circular 11/2020/TT-BCT.

Notably, goods originating from Vietnam imported into the European Union shall enjoy tariff preferences according to EVFTA when one of the following certificates of origin is available:

- C/O issued in accordance with the provisions of Article 4 and from Articles 20 to 23 of Circular 11/2020/TT-BCT.

- Self-certification of origin according to the provisions of Article 25 of Circular 11/2020/TT-BCT issued by an exporter for consignments not exceeding 6,000 EUR (six thousand euros).

- Self-certification of origin issued by an eligible exporter or an exporter registered in the database in accordance with the Ministry of Industry and Trade regulations.

- The self-certification of origin for goods specified in point c of this clause shall be implemented in accordance with the Ministry of Industry and Trade regulations and applied after Vietnam notifies the European Union.

Note: In the case of applying Article 29 Circular 11/2020/TT-BCT, goods of origin are eligible for EVFTA preference without the need to submit certificates of origin specified in this Article.
