Entitlement to full-pay leave is a policy provided for employees as stipulated in the Labor Code 2012. So, under what circumstances are employees entitled to their salary even when they are not working?
1. Annual Leave
According to Clause 1, Article 111 of the Labor Code 2012, an employee who has worked for an employer for 12 months is entitled to annual leave with full pay as per the labor contract. The number of vacation days depends on the nature of the work but is at least 12 days per year.
2. Holiday and Tet Leave
In a year, there is a total of 10 public holidays and Tet holidays that employees are entitled to with full pay, including:
- New Year's Day: 1 day (January 1 on the Gregorian calendar);
- Lunar New Year: 5 days;
- Victory Day: 1 day (April 30 on the Gregorian calendar);
- International Labor Day: 1 day (May 1 on the Gregorian calendar);
- National Day: 1 day (September 2 on the Gregorian calendar);
- Hung Kings' Commemoration Day: 1 day.

3. Personal Leave
According to Clause 1, Article 116 of the Labor Code 2012, these are the cases:
- Getting married: 3 days off;
- Child getting married: 1 day off;
- Death of biological father, biological mother, spouse's father, spouse's mother, spouse, child: 3 days off.
Thus, the total number of paid leave days for an employee in a year is at least 22 days, plus the personal leave days with full pay, making a total of 29 days.
Additionally, the Draft Revised Labor Code is being developed with a proposed addition of a public holiday on War Invalids and Martyrs' Day on July 27. Therefore, in the near future, employees may have an additional paid day off.
