On July 26, 2024, the Government of Vietnam issued Decree 100/2024/ND-CP detailing certain provisions of the Housing Law 2023 regarding the development and management of social housing.
Article 76 of the Housing Law 2023 specifies the entities eligible for support policies regarding social housing in Vietnam, including:
(1) Persons with contributions to the revolution, relatives of martyrs who are eligible for housing improvement support as stipulated by the Ordinance on Preferences for Persons with Contributions to the Revolution.
(2) Poor and near-poor households in rural areas.
(3) Poor and near-poor households in rural areas regularly affected by natural disasters and climate change.
(4) Poor and near-poor households in urban areas.
(5) Low-income individuals in urban areas.
(6) Workers, laborers working in enterprises, cooperatives, and cooperative alliances inside and outside industrial zones.
(7) Officers, professional soldiers, non-commissioned officers of the people's armed forces, police workers, officials, and defense public employees serving in active duty; those involved in cypher work, other personnel in cypher organizations receiving salaries from the state budget.
(8) Officials and public employees as prescribed by the law on officials and public employees.
(9) Persons returning public housing according to Clause 4, Article 125 of the Housing Law 2023, except for cases where public housing is retrieved due to violations of the Housing Law 2023.
(10) Households and individuals whose land is acquired and who must evacuate and demolish their houses according to the law but have not been compensated by the State with housing or homestead land.
(11) Students, undergraduates, academy attendees, university, college, vocational school students, and students in specialized schools as prescribed by law; students of public boarding ethnic schools.
(12) Enterprises, cooperatives, cooperative alliances in industrial zones.
Clause 1, Article 77 of the Housing Law 2023 states that the sale, lease-purchase, and rental support of social housing is provided to the subjects specified in Clauses 1, 4, 5, 6, 8, 9, and 10 of Article 76 of the Housing Law 2023; and subjects specified in Clause 7 of Article 76 of the Housing Law 2023 who have not received housing support policies for the people's armed forces.
Depending on local conditions, the provincial People's Committee may regulate the support for the sale, lease-purchase, and rental of social housing for subjects specified in Clauses 2 and 3 of Article 76 of the Housing Law 2023.
Section 5 of Decree 100/2024/ND-CP stipulates the conditions for support policies regarding social housing, including housing and income conditions:
Housing Conditions
- The case of not having owned housing is determined when the subjects specified in Clause 1, Article 77 of the Housing Law 2023 and their spouse (if any) are not listed in the Certificate of land use rights, ownership of assets attached to the land in the province, centrally-run city where the social housing project is located at the time of submitting the application for purchasing or leasing-purchasing social housing.
Within 07 days from the date of receiving the application for confirming the names in the Certificate of land use rights, ownership of assets attached to the land, the district-level Land Registration Office/Branch of the province, centrally-run city where the social housing project is located shall confirm for the case specified in Clause 1, Article 30 of Decree 100/2024/ND-CP.
- The case where the subjects specified in Clause 1, Article 77 of the Housing Law 2023 own housing but the average housing area per person is less than 15 m²/person. The average housing area per person specified in Clause 2, Article 30 of Decree 100/2024/ND-CP is determined based on the registered permanent residence of the applicant, spouse (if married), their parents (if any), and children (if any).
Within 07 days from the date of receiving the application for confirming the average housing area per person, the commune-level People's Committee shall confirm for the case specified in Clause 2, Article 29 of Decree 100/2024/ND-CP.
Income Conditions
- For subjects specified in Clauses 5, 6, and 8 of Article 76 of the Housing Law 2023, income conditions must be met as follows:
+ If the applicant is single, the actual monthly income must not exceed 15 million VND, as certified by the salary table verified by the agency, unit, or enterprise where the applicant works.
+ If the applicant is married according to the law, the combined actual monthly income of the applicant and their spouse must not exceed 30 million VND, as certified by the salary table verified by the agency, unit, or enterprise where the applicant works.
+ The determination period for income conditions is one consecutive year from the time the applicant specified in Clause 1, Article 30 of Decree 100/2024/ND-CP submits a valid application to the investor for purchasing or leasing-purchasing social housing.
- For the subjects specified in Clause 5, Article 76 of the Housing Law 2023 without an employment contract, if single, the actual monthly income must not exceed 15 million VND; if married according to the law, the combined actual monthly income of the applicant and their spouse must not exceed 30 million VND. Within 07 days from the date of receiving the income verification application, the commune-level People's Committee shall verify the income condition for one consecutive year from the time the applicant specified in Clause 2, Article 30 of Decree 100/2024/ND-CP submits a valid application to the investor for purchasing or leasing-purchasing social housing.
- For the subjects specified in Clauses 2, 3, and 4 of Article 76 of the Housing Law 2023, they must be classified as poor or near-poor households according to the poverty standards of the Government of Vietnam.
- For the subjects specified in Clause 7 of Article 76 of the Housing Law 2023, the income conditions apply as stipulated in Article 67 of Decree 100/2024/ND-CP.
