Enterprises have navigation software/equipment containing maps that violate sovereignty of the Socialist Republic of Vietnam shall have its license for motor vehicle import revoked

This is a completely new content mentioned in Decree No. 17/2020/NĐ-CP of Vietnam’s Government on amendments to Decree No. 116/2017/NĐ-CP dated October 17, 2017 of Vietnam’s Government on requirements for manufacturing, assembly and import of motor vehicles and trade in motor vehicle warranty and maintenance services.

Specifically, according to Clauses 5, 6 Article 1 of Decree No. 17/2020/NĐ-CP of Vietnam’s Government supplementing Article 19 of Decree No. 116/2017/NĐ-CP, from March 22, 2020, enterprises importing and temporarily importing motor vehicles have navigation software/equipment containing maps that violate sovereignty, unity and territorial integrity of the Socialist Republic of Vietnam shall have its license for motor vehicle import suspended.

The remaining cases of suspension or revocation of licenses for motor vehicle import granted to enterprises remain the same as specified in Decree No. 116/2017/NĐ-CP of Vietnam’s Government. The license for motor vehicle import shall be suspended or revoked according to the Minister of Industry and Trade’s decision specifying reasons for suspension or revocation.

Within 5 working days from the day on which the decision on revocation is given, the applicant shall return the license to the Ministry of Industry and Trade. The Ministry of Industry and Trade shall inform the customs and publish information about suspension or revocation of the license.

Moreover, after the license is revoked, the motor vehicle importer shall be entitled to have a new license issued provided that he/she follows the procedures specified in Article 16 Decree No. 116/2017/NĐ-CP of Vietnam’s Government.

In addition, Decree No. 17/2020/NĐ-CP also newly promulgates the “Application form for the license for motor vehicle import” No. 15 in Section III, replacing form No. 05 in the Appendix enclosed with Decree No. 116/2017/NĐ-CP of Vietnam’s Government.
