Enhancing Case Law and Mediation at Court

Attending the Conference were leaders of the Party, ministries, and central authorities, connected via 800 satellite locations throughout local courts and military courts across the country.

In his speech at the Conference, Member of the Politburo, Secretary of the Central Committee of the Communist Party, Chief Justice of the Supreme People's Court Nguyen Hoa Binh emphasized: In 2022, building a professional, modern, rule-of-law court system to protect the interests of the State, and the rights of organizations and individuals. The entire court sector achieved the targets set by the National Assembly and the sector itself.

The major highlight is that the court system has completed all significant initiatives assigned by the Central Committee, such as the scheme for building a rule-of-law State, judicial reforms, the establishment of electronic courts, and courts for juveniles.

Simultaneously, bringing major cases of corruption and economic crimes to trial accurately and lawfully, reclaiming embezzled assets, has been highly appreciated by the public.

Regarding the task of legal institutional development, Chief Justice Nguyen Hoa Binh noted that at the beginning of the 15th National Assembly session, three ordinances were submitted and passed, which were highly appreciated by the National Assembly.

"Notably, the court system has developed many Resolutions, including the development of case law, which has become a norm and habit for judges, with more than 1,000 cases citing case law. The court sector has also implemented the National Assembly's Resolution on high-rate mediation in court, helping reduce the court's trial workload, ensuring security, order, and resources for the state and the people," Chief Justice Nguyen Hoa Binh noted.

Additionally, the online trial work of the courts has made significant efforts with over 5,000 cases, creating positive social feedback, especially in the complex context of the pandemic.

The court system has strongly applied information technology in the trial process, especially using case management and virtual assistants, which many judges use to reference in their work.

Alongside the achievements made, Chief Justice Nguyen Hoa Binh also frankly pointed out the limitations and shortcomings that need addressing. Specifically, there remain weaknesses in administrative case trials, with insufficient quality and a high rate of revisions; limitations in addressing supervisory and retrial petitions due to an overwhelming number, all being forwarded to the Supreme People's Court.

Every Local Court Must Introduce One Case Law

For 2023's tasks and solutions, Chief Justice Nguyen Hoa Binh requires all levels of courts and staff to strive continuously, overcome difficulties to achieve the basic trial targets assigned by the National Assembly. Enhance the quality of administrative case trials with the participation of the local authorities and relevant parties.

Among these, the court system must effectively implement the 6th Central Committee Resolution, identified by the court sector as a focus on judicial reforms, providing an opportunity for the courts to rise to a new height in their operations.

According to Chief Justice Nguyen Hoa Binh, it is necessary to develop an action program for the sector such as amending the Law on People's Court Organisation, based on enhancing achievements and overcoming shortcomings during the implementation of this Law in recent times. To do this, the involvement of the entire system is necessary.

Chief Justice of the Supreme People's Court requires each locality to introduce one case law, with larger cities introducing more. Any locality failing to introduce one will not be considered as having completed the task.

Strengthen party building and rectification within the court system, seriously prevent violations in court operations.

In his speech, Chief Procurator of the Supreme People's Procuracy Le Minh Tri pointed out increasing workload pressures while the legal system is not fully complete, while we are implementing the law to protect justice and the legal rights and interests of organizations and individuals.

To avoid wrongful convictions and improve the quality of procedural activities, there must be better coordination among sectors, especially between investigating agencies, procuracies, and courts, showing very effective results in 2022.

Deputy Minister of Public Security Nguyen Duy Ngoc highly appreciated the increasing professionalism and prompt sharing in the operations of procedural agencies, evaluated objectively, effectively, and legally conformed, such as the new provision allowing investigators to debate in court, which meets the requirements and is highly appreciated by the public and lawyers.

The summary report from the Supreme People's Court indicates that in 2022, the courts handled 567,521 cases, resolving 504,681 cases (an 88.9% resolution rate, up 7.7% from 2021). The rate of judgments and decisions being overturned or revised due to subjective reasons from the courts is 0.9%, meeting the requirement set by the National Assembly and the court sector, which is no more than 1.5%.
