In addition to the activities that Enforcement Officer (Thua phat lai) is not allowed to perform as previously stipulated in Decree 61/2009/ND-CP, the new decree has added a regulation that Enforcement Officers are not allowed to concurrently hold other judicial titles.
To be specific, according to Clause 3 Article 4 of Decree 08/2020/ND-CP on activities that Enforcement Officers are not allowed to perform:
“3. Concurrently practicing as a notary, lawyer, appraiser, auctioneer, asset manager, or liquator.”
Previously, in Decree 61/2009/ND-CP, this non-concurrent regulation was part of the criteria for the appointment of Enforcement Officers. However, from February 24, 2020, it will officially be classified as activities that Enforcement Officers are not allowed to perform.
