Electricity-related consulting services in Vietnam

Decree No. 08/2018/NĐ-CP of Vietnam’s Government was issued on January 15, 2018, which provides amendments to certain articles of Decree No. 137/2013/NĐ-CP detailing implementation of a number of Articles of the Electricity Law, and the Law amending and supplementing a number of articles of the Electricity Law, in particular, amending regulation on electricity-related consulting services.

Specifically, according to Clause 7 Article 6 of Decree No. 08/2018/NĐ-CP of Vietnam’s Government amending Article 38 of Decree No. 137/2013/NĐ-CP, electricity-related consulting services are specified as follows:

- Electricity-related consulting services include: Consulting on investment in electrical construction works (excluding planning projects or electrical works bidding) and consulting on supervision of electrical works (including hydroelectric power stations, thermal power stations, power lines and substations).

- Provision of electricity-related consulting services shall only apply to construction works directly related to electricity or construction works applied under regulations of law on construction.

- Ranking of scales of electricity sources and grids serving electricity-related consulting services shall be stated in the following table:

1st rank	Over 300 MW	Over 300 MW	Over 220 kV
2nd rank	Up to 300 MW	Up to 300 MW	Up to 220 kV
3rd rank	Up to 100 MW		Up to 110 kv
4th rank	Up to 30 MW		Up to 35 kv

- Power stations using renewable energy in the principle of using water energy, wind energy and solar energy shall be ranked and be entitled to apply to licensing conditions for electricity-related consulting services same as those for hydroelectric power stations.

- Power stations using renewable energy in the principle of conversion from thermal energy shall be ranked and be entitled to apply to licensing conditions for electricity-related consulting services same as those for thermal power stations.
