The Ministry of Natural Resources and Environment of Vietnam has just issued economic-technical norms under the scope of local land management in Vietnam

On September 20, 2024, the Ministry of Natural Resources and Environment issued Official Dispatch 6647/BTNMT-QHPTTND regarding Economic-technical norms under the scope of local land management in Vietnam.

Economic-technical norms under the scope of local land management in Vietnam

The Land Law of 2024 took effect on August 1, 2024; the Government of Vietnam has issued decrees guiding the implementation of the Land Law, which contain many provisions related to assigning tasks, ordering, or bidding to provide public service products within the scope of local land management.

To expedite the implementation of tasks under the Land Law promptly and effectively, the Ministry of Natural Resources and Environment requests the People's Committees of the provinces and centrally-run cities to direct the relevant units to:

- Urgently advise on issuing economic-technical norms, cost norms (if any), and product prices in the land sector to be applied locally. The formulation of economic-technical norms, cost norms (if any), and product prices shall comply with the provisions of Decree 32/2019/ND-CP dated April 10, 2019, of the Government of Vietnam stipulating the assignment, ordering, or bidding to provide public service products using state budget funds from regular expenditure sources and the Prime Minister's direction at Official Dispatch 9652/VPCP-KTTH dated November 18, 2020, of the Government Office regarding the implementation of Decree 32/2019/ND-CP; and the Ministry of Finance's guidance at Official Dispatch 13257/BTC-HCSN dated November 22, 2021, on the implementation guidance of Decree 32/2019/ND-CP of the Government of Vietnam (in which the authority to issue documents is according to the provisions of Clause 2, Article 26 of Decree 32/2019/ND-CP).

- The Ministry of Natural Resources and Environment requests the People's Committees of the provinces and centrally-run cities, during the process of formulating economic-technical norms in the land sector for local application, to reflect any difficulties or obstacles related to state management of land to the Ministry of Natural Resources and Environment for guidance and coordination according to the assigned functions and tasks.

Regulations on the Establishment of Economic-Technical Norms Programs within the State Management of the Ministry of Natural Resources and Environment of Vietnam

The regulations on the establishment of economic-technical norms programs within the state management scope of the Ministry of Natural Resources and Environment are stipulated in Article 7 of Circular 16/2021/TT-BTNMT as follows:

- The economic-technical norms programs within the state management scope of the Ministry of Natural Resources and Environment are prepared in the final year of the five-year planning period; no later than July 15 of the final year of the planning period, the Departments of Natural Resources and Environment and relevant organizations and individuals shall submit proposals to the Ministry of Natural Resources and Environment for consideration and compilation.

- State management units under the Ministry of Natural Resources and Environment shall review and compile the list of economic-technical norms programs in the assigned management areas according to Form No. 01 issued with Circular 16/2021/TT-BTNMT, no later than July 30, and send them to the Department of Planning and Finance for compilation and submission to the Minister of Natural Resources and Environment.

- The economic-technical norms program must be sent for consultation to relevant ministries, ministerial-level agencies, and provincial People's Committees; in case the proposed norms need to be adjusted or supplemented, the Ministry of Natural Resources and Environment shall instruct the relevant state management units to absorb, explain, and complete the economic-technical norms program no later than August 31.
