On November 12, 2024, the Minister of Public Security of Vietnam issued Circular 63/2024/TT-BCA providing regulations on inspection, control, and handling of legal violations in the field of railway traffic by the Traffic Police.
According to Article 4 of Circular 63/2024/TT-BCA, the duties of the Traffic Police in railway traffic inspection and control include:
- Implement orders, plans for inspection, control, and handling of violations issued by competent authorities.
- Inspect, control, and handle violations to ensure security, order, and safety in railway traffic within the assigned routes and areas.
- Detect, promptly prevent and handle legal violations in the field of railway traffic, other legal violations, and ensure security and order per regulations; cooperate with relevant functional agencies and units to detect and prevent violations of regulations protecting railway projects and railway traffic safety corridors.
- Coordinate in investigating, verifying, and resolving railway traffic accidents according to legal provisions and Ministry of Public Security’s regulations.
- Directly, or in cooperation with units within and outside the People's Public Security force, combat crime and other legal violations on railway traffic routes. Participate in counter-terrorism, suppress riots; prevent and control epidemics, natural disasters; firefighting, rescue, and relief on railway traffic routes according to regulations.
- Collaborate with relevant agencies, organizations, and individuals to organize and ensure security, order, and safety in railway operations.
- Assist, support railway traffic participants when necessary.
- Through inspection, control, and handling of violations, execute tasks to:
+ Discover loopholes, shortcomings, and inadequacies in state management of railway operations, report, and propose competent authorities to recommend relevant agencies to take prompt corrective measures;
+ Guide, propagate, and mobilize the public to ensure order and safety in railway traffic and comply with railway traffic laws.
- Perform other tasks of the People's Public Security force per legal regulations.
In railway traffic inspection and control, the Traffic Police will have the following powers:
- Inspect and control individuals and vehicles related to railway traffic activities according to provisions of the Railway Law 2017 and related legislation.
- Apply measures to prevent and handle administrative violations in the field of railway traffic, other legal violations, and ensure security and order per regulations.
- In urgent cases to protect national security, ensure social order and safety, or to prevent occurring or potential social harm, Traffic Police officers on duty can mobilize vehicles, communication means of agencies, organizations, individuals, and those operating or using these means according to the Public Security Law 2018 (amended and supplemented in 2023). This mobilization is performed in the form of a direct request or in writing.
- Equipped, and utilize road transport vehicles; professional technical means and equipment; weapons, support tools; communication means; other technical means according to the Law on Handling Administrative Violations 2012 (amended and supplemented in 2020); Law on Management and Use of Weapons, Explosives, and Support Tools 2024; other related regulations and those of the Ministry of Public Security.
- Exercise other powers of the People's Public Security force according to legal regulations.
