On February 7, 2025, the Minister of Education and Training issued Circular 03/2025/TT-BGDDT providing guidance on the Management Council in public service providers in the field of education and training.

According to Clause 5, Article 3 of Circular 03/2025/TT-BGDDT, members of the Management Council have the following duties and powers:

- Carry out tasks assigned by the Management Council and the Chairman of the Management Council; other duties and powers as prescribed by law, the Operational Regulation of the Management Council, and the Organizational and Operational Regulation of the public service provider;

- Participate in developing periodic and annual activity plans; propose contents and issues to be discussed at Management Council meetings;

- Attend Management Council meetings, provide opinions, and vote on issues discussed in the meetings;

- Be provided with and access information and documents necessary for the Management Council's work as prescribed; enjoy policies and benefits as prescribed by law and the financial regulations, internal spending regulations of the public service provider;

- Be responsible for fulfilling their duties and exercising their powers.

Number and structure of members of the Management Council in public service provider in the field of education in Vietnam from March 25, 2025

The number and structure of the members of the Management Council are stipulated in Article 4 of Circular 03/2025/TT-BGDDT as follows:

- The number of members of the Management Council must be odd, with the quantity specified in Clause 4, Article 7 of Decree 120/2020/ND-CP, including the Chairman, Vice-Chairman (if any), Secretary, and other members of the Management Council. The Chairman, Vice-Chairman (if any), Secretary, and other members of the Management Council are appointed by the head of the authority approving the autonomy Scheme of the public service provider.

- Structure of the Management Council members

+ Representative of the state management agency in education (if any);

+ Representative of the supervisory agency of the public service provider as stipulated in Clause 4, Article 7 of Decree 120/2020/ND-CP;

+ Representative of the leadership of the public service provider with a Management Council (leadership includes: head, deputy head of the public service provider);

+ Representative of public employees, workers of the public service provider with a Management Council;

+ Representatives of experts, managers knowledgeable about issues related to the functions, duties, powers of the public service provider.

- The specific number and structure of Management Council members are decided by the head of the authority approving the autonomy Scheme of the public service provider according to the aforementioned provisions.
