Circular 05/2018/TT-BGTVT was issued by the Ministry of Transport on January 30, 2018, specifying the duties and powers of the Management Council of the public service provider.
To be specific, Circular 05 stipulates that the Chairman of the Management Council of a public service provider has the following duties and powers:
- Directing the development of quarterly and yearly operational plans of the Management Council.- Directing the preparation of agendas, materials for meetings, or gathering opinions from members of the Management Council.- Convening and presiding over meetings or gathering opinions from members of the Management Council.- Leading the implementation of the resolutions of the Management Council.- Organizing the supervision and evaluation of the achievement of strategic objectives, operational results of the public service provider, and the management and operation outcomes of the head of the public service provider.- Administering the activities of the Management Council in accordance with the tasks stipulated in Article 8 of this Circular.- Performing other duties and exercising other powers as prescribed by law and the regulations of the unit.
In addition, Circular 05 also specifies the duties and powers of the members of the Management Council as follows:
- Attending the meetings of the Management Council.- Proposing to the Chairman of the Management Council the contents and issues to be discussed in the Management Council.- Providing comments, voting on issues put forth for discussion in the meetings of the Management Council.- Performing tasks assigned by the Management Council; other duties and powers as prescribed by law and the regulations of the unit.
