Duties and powers of the district-level People's Council in Vietnam in 2025

On February 19, 2025, the XV National Assembly of the Socialist Republic of Vietnam, at its 9th Extraordinary Session, adopted the Law on Organization of Local Government 2025.

Article 18 of the Law on Organization of Local Government 2025 stipulates the duties and powers of district-level People's Councils as follows:

(1) The district-level People's Council shall perform the following duties and powers:

- Decide on measures to ensure the implementation of the Constitution and laws within the locality;

- Decide on policies, socio-economic development plans, and plans for the development of sectors and fields in the locality according to the legal provisions;

- Decide on the state budget revenue estimates within the locality; estimate and allocate the local budget's revenue and expenditure; adjust the local budget estimates when necessary; approve the local budget settlement;

- Decide on measures to develop economic fields, land, resources, environment, education, health, culture, information, tourism, sports; implement social policies; ensure national defense, security, social order, and safety tasks; protect the assets of agencies, organizations, safeguard citizens' lives, freedoms, honor, dignity, property, and other legitimate rights and interests, ensure human rights, combat corruption, negativity, waste, crime, and other law violations within the locality according to legal provisions;

- Issue the working Regulation of the People's Council, the Standing Committee of the People's Council, the Committees of the People's Council, the delegations of the People's Council, and the People's Council deputies at their level;

- Decide on the establishment, reorganization, renaming, dissolution of specialized agencies under the People's Committee at the same level according to law;

- Decide on the staffing of officials in the agencies of the local government at their level, the number of people working with salaries from the state budget in public service providers within the management scope as per the staffing quota assigned by competent authorities; specifically decide on the number of commune-level officials and non-specialized personnel at the commune level, in villages, and residential groups according to legal provisions and competent authorities;

- Consider and give opinions on the establishment, dissolution, merging, dividing administrative units, adjusting boundaries, and renaming administrative units at their level and subordinate commune levels;

- Decide on the establishment, reorganization, dissolution, naming, renaming of villages, and residential groups according to legal provisions;

- Elect, dismiss, remove from office the Chairman, Vice-Chairman of the People's Council, Head of the Council's Committees at their level; elect, dismiss, remove from office the Chairman, Vice-Chairman, and Members of the People's Committee at the same level; elect, dismiss, remove from office the jurors according to legal regulations;

- Take votes of confidence, vote of confidence for persons holding positions elected by the People's Council according to legal regulations;

- Supervise the implementation of the Constitution and laws in the locality and the implementation of the resolutions of the People's Council at their level; supervise the activities of the People's Committee, People's Court, People's Procuracy at the same level, and other local agencies according to legal regulations;

- Remove People's Council deputies and approve dismissal of the People's Council deputies' responsibilities according to legal provisions;

- Issue resolutions on matters under the duties and powers of the People's Council at their level; revoke, amend, supplement documents issued by themselves when found inappropriate or against the law;

- Revoke part or whole illegal documents of the People's Committee, Chairman of the People's Committee at the same level and subordinate commune-level People's Councils;

- Dissolve subordinate commune-level People's Councils in cases where they seriously damage the interests of the People and submit to the provincial People's Council for approval;

- Perform decentralized duties and powers and other duties and powers according to legal regulations.

(2) The People's Council of district-level towns, provincial cities, and cities under the centrally-governed city shall perform the duties and powers prescribed in (1) and the following duties and powers:

(i) Decide on mechanisms, policies, measures for urban development, urban infrastructure within the locality according to legal provisions;

(ii) Decide on measures for population management and organizing the population's lifestyle, ensuring public order and urban landscape within the locality according to legal provisions.

(3) The People's Council of a district performs the duties and powers prescribed in (1) and point (ii).
