Duties and Powers of the Authority Appraising Operational Conditions for Environmental Monitoring Services

From June 09, 2015, Circular 19/2014/TT-BTNMT of the Ministry of Natural Resources and Environment, stipulating detailed regulations on the appraisal of conditions for environmental monitoring service activities and the certification form, will take effect.

According to Article 5 of Circular 19/2015/TT-BTNMT, the duties and powers of the appraisal authority for environmental monitoring service operational conditions are as follows:

  1. Review, evaluate, and handle dossiers and related documents submitted by organizations requesting certification of eligibility for environmental monitoring service operations.

  2. Study and evaluate the dossiers of organizations requesting certification of eligibility for environmental monitoring service operations; organize opinions to evaluate and review the dossiers and prepare a Dossier Evaluation Report.

  3. Propose the establishment of an Evaluation Team to conduct on-site inspections at organizations requesting certification of eligibility for environmental monitoring service operations and establish an Appraisal Council for environmental monitoring service operational conditions.

  4. Prepare, provide, and facilitate the research of dossiers and related documents for the appraisal of environmental monitoring service operational conditions by members of the Evaluation Team and members of the Appraisal Council.

  5. Prepare the necessary conditions for the Evaluation Team to carry out on-site inspections and evaluations at the organizations and for the Council to conduct official sessions.

  6. Receive inspection and on-site evaluation minutes from the Evaluation Team; the appraisal results from the Appraisal Council and proceed with the necessary procedures to submit to the Minister of Natural Resources and Environment for decisions on issuance, extension, modification of content, reissuance, temporary suspension, revocation, and cancellation of the Certificate of Eligibility for Environmental Monitoring Service Operations.

  7. Notify the organization in case of rejection for issuance, modification of content, extension, or reissuance of the Certificate of Eligibility for Environmental Monitoring Service Operations for consideration by competent authorities.

  8. Preserve dossiers and documents related to the appraisal process of the conditions of organizations operating environmental monitoring services.

  9. Monitor, aggregate, and report to competent authorities regarding information about environmental monitoring service operations of certified organizations.

  10. Establish, post, and continuously update the list of organizations eligible for environmental monitoring service operations on the website of the Ministry of Natural Resources and Environment and the General Department of Environment.

  11. Perform other tasks related to the appraisal, issuance, content modification, extension, reissuance, temporary suspension, revocation, and cancellation process for the Certificate of Eligibility for Environmental Monitoring Service Operations.
