Duties and powers of members of the Management Council in a public S&T organization in Vietnam

Circular 19/2022/TT-BKHCN stipulates the duties and powers of members of the Management Council in a public science and technology organization in Vietnam as follows:

(1) Duties and powers of members of the Management Board

- Performing tasks assigned by the Management Board; other tasks and powers as prescribed by law and operation regulations of the Management Council and of public science and technology organizations.

- Participating in the development of annual and term-based operational plans; proposing contents and issues to be discussed at the meeting of the Management Board.

- Attending meetings of the Management Board, giving opinions, and voting on issues discussed in the meetings of the Management Board. Being responsible for the decisions of the Management Board and being personally responsible for his/her voting in the meetings of the Management Board.

- Confidentiality of information provided in accordance with the law.

(2) Secretary of the Management Board

To perform the duties and powers of members of the Management Board as prescribed in Clause (1) and directly assist the Chairman of the Board in managing the following tasks:

- Summarizing information about the unit's operation and reporting to the Chairman of the Management Board; preparing agendas, documents, and meeting invitations and acting as secretary of meetings of the Management Board; building, completing, and archiving documents of the Management Board;

- Preparing reports and explanatory documents for state agencies and related agencies according to the tasks and functions of the Management Council;

- Other tasks assigned by the Chairman of the Management Board and according to the Regulation on the Operation of the Management Board.

(3) Duties and powers of the Vice Chairman of the Management Board

- Managing operations and signing documents as authorized.

- Performing the duties and powers of the members of the Management Board as prescribed in Clause 1 of this Article and other duties and powers according to the Operational Regulations of the Management Board.

(4) Duties and powers of the Chairman of the Management Board

- Directing the Management Council to perform the tasks and powers specified in Clause 3, Article 7 of Decree No. 120/2020/ND-CP.

- Organizing the monitoring and evaluation of the results of the implementation of strategic goals and operational results of public science and technology organizations and the executive management results of heads of public science and technology organizations.

- Directing the development of the annual and quarterly working plans of the Management Board; leading the implementation of the resolutions of the Management Board.

- Convening and chairing meetings of the Management Board; authorizing the Vice Chairman to chair meetings of the Management Board in his absence; directing the preparation of meeting agendas and documents; or collecting opinions from members of the Management Board.

- Signing documents of the Management Board.

- Performing other duties and exercise other powers as prescribed by law or in accordance with the operation regulations of the Management Board.
