Below are the new regulations on the duration of state secret protection for inspection, supervision, and discipline work of the Vietnam Communist Party from December 30, 2024.

The Central Executive Committee of Vietnam promulgated Regulation 225-QD/TW on December 30, 2024, declassifying information regarding the inspection, supervision, and discipline work of the Vietnam Communist Party.

According to Regulation 225-QD/TW, state secrets involving the inspection, supervision, and discipline work of the Communist Party consist of critical content determined by the head of the party committee, party organization, or advisory agency to be of a confidential nature, based on the provisions of the Law on State Secret Protection. These have not been publicly disclosed, and their disclosure or loss could endanger national interests and those of the Communist Party.

The forms containing state secrets about the inspection, supervision, and discipline work of the Communist Party include documents, objects, locations, speech, activities, or other forms.

Article 5 of Regulation 225-QD/TW clearly states the duration of state secret protection as follows:

- The duration of state secret protection for information on the inspection, supervision, and discipline work of the Communist Party is counted from the date the classification of the state secret is determined until the expiration of the following durations:

+  30  years  for  top  secret  state  secrets.

+  20  years  for  secrect  state  secrets.

+  10  years  for  confidential  state  secrets.

- The duration of state secret protection for information about the inspection, supervision, and discipline work of the Communist Party can be determined to be shorter than the above-stipulated period and must be specifically indicated on the "DURATION OF STATE SECRET PROTECTION" stamp affixed directly to the document or object containing the state secret when the classification is determined.

- For state secrets regarding information on the inspection, supervision, and discipline work of the Communist Party identified as top secret by the Central Executive Committee of the Communist Party, the Politburo, the Secretariat, or the Central Inspection Commission, the declassification of records, documents containing top secret state secrets shall be decided by the Politburo.

- The classification and duration for state secret protection of information regarding the inspection, supervision, and discipline work of the Communist Party contained within a file or document is determined by the document with the highest classification and the longest duration for state secret protection (if the classification is the same) stored in that file.

Declassification of state secrets for information on the inspection, supervision, and discipline work of the Vietnam Communist Party

State secrets for information concerning the inspection, supervision, and discipline work of the Communist Party are automatically declassified in the following cases:

- Expiry of the state secret protection duration and the extension period as stipulated in Article 5 and Article 6 of Regulation 225-QD/TW without further extension.

- Documents or objects containing state secrets about the inspection, supervision, and discipline work of the Communist Party no longer belong to the category of state secrets.

Party committees, party organizations, advisory agencies that identify state secrets regarding the inspection, supervision, and discipline work of the Communist Party must stamp, have documentation determining declassification, and immediately notify relevant agencies, organizations, or individuals in writing.

Declassification of State Secrets regarding the Inspection, Supervision, and Discipline Work of the Communist Party Before the Term

To meet practical requirements for protecting the interests of the nation, ethnicity, and the Communist Party; economic-social development; international integration, and cooperation, it may be considered, decided to declassify entirely or a part before the duration specified in Clause 1 Article 5 of Regulation 225-QD/TW.

Regulation 225-QD/TW takes effect from December 30, 2024.
