Regarding this issue, LawNet would like to answer as follows:
On December 30, 2023, the Government issued Decree 96/2023/ND-CP detailing a number of articles of the Law on Medical Examination and Treatment 2023.
According to Article 3 of Decree 96/2023/ND-CP, the time and content of practice to grant a medical examination and treatment practice license are as follows:
- Duration of practicing medical examination and treatment for the title of doctor is 12 months, of which:
+ Duration of practicing medical examination and treatment is 9 months;
+ Duration of practicing medical examination and treatment in emergency resuscitation is 03 months.
- Duration of practicing medical examination and treatment for the position of physician is 09 months, of which:
+ Duration of practicing medical examination and treatment is 6 months;
+ Duration of practicing medical examination and treatment in emergency resuscitation is 03 months.
- Duration of practicing medical examination and treatment for nursing, midwifery, and medical technician positions is 06 months, of which:
+ Duration of practicing medical examination and treatment is 5 months;
+ Duration of practicing medical examination and treatment in emergency resuscitation is 01 month.
- Duration of practicing medical examination and treatment for clinical nutrition positions is 06 months.
- Duration of practicing medical examination and treatment for the position of out-of-hospital emergency paramedic is 06 months, of which:
+ Duration of practicing medical examination and treatment of outpatient emergency medicine is 03 months;
+ Duration of practicing medical examination and treatment in emergency resuscitation is 03 months.
- Duration of practicing medical examination and treatment for clinical psychology positions is 09 months.
- During the practical training, it is necessary to integrate the instructions on legal regulations regarding medical examination and treatment, professional regulations, professional ethics, patient safety, communication skills, and the professional conduct of healthcare practitioners.
- Based on the scope of practice issued by the Minister of Health and the regulations mentioned above, the practice guide base develops specific practice content for each professional title, and the facility plans to organize practice instructions.
Pursuant to Article 4 of Decree 96/2023/ND-CP, regulations on the reservation of medical examination and treatment practice results for professional titles are as follows:
- The practice instruction facility is responsible for ensuring that practitioners can work according to the facility's working regime. During practice due to health reasons or force majeure, the practitioner is allowed to temporarily suspend practice for a maximum period of 12 months and retain previous practice results.
- Reservation of practice results is carried out as follows:
+ The practitioner submits a written request to reserve the practice results and attaches documents proving the reason for the request to reserve;
+ Based on the request of the practitioner, the head of the medical examination and treatment facility shall consider and decide on the reservation, in case of disagreement with the reservation, the head of the medical examination and treatment facility must respond in writing, clearly stating the reason;
+ Within 30 days after the end of the reservation period, if the practitioner does not have a written request to continue practicing or a request to extend the reservation period, the reservation results are no longer valid, and the total duration of the reservations must not exceed 12 months.
